A RESOLUTION SUPPORTING ASSEMBLY
2537 REGARDING THE EXTENSION
EXEMPTION FOR VOLUNTEER
PARTICIPATING ON PUBLIC WORKS
DEFINED BY EXISTING LAW

WHEREAS, existing law defines "public works," for purposes of regulating
public works contracts, as, among other things, construction, alteration, demolition,
installation, or repair work that are performed under contract and paid for in whole or in
part out of public funds; and
WHEREAS, pursuant to existing law, all workers employed on public works
projects shall be paid not less than the general prevailing rate of per diem wages for
work, except for public works projects of $1,000 or less, or except for any work
performed on or after January 1, 2002, and until January 1, 2009, by a volunteer, a
volunteer coordinator, or by members of the California Conservation Corps or of
certified Community Conservation Corps; and
WHEREAS, Assembly Bill 2537 would extend, until January 1, 2012, the
exemption from the definition of "public works" for any work performed by a volunteer, a
volunteer coordinator, or by members of the California Conservation Corps or of
certified Community Conservation Corps.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct;
2. The City of Bakersfield supports the exemption of volunteers from the
general prevailing rate of per diem wages for public works projects as
proposed by Assembly Bill 2537; and
3. Staff is additionally authorized to draft letters in support and forward them
to the appropriate members of the Assembly or Senate, if the Bill is
forwarded to the Senate.
