RESOLUTION
A RESOLUTION REQUESTING RECONSlDERATION ON THE
DECISION BY THE LOCAL AGENCY FORMATION
COMMISSION ON SPHERE OF INFLUENCE AMENDMENT
1-97
WHEREAS, the City Council of the City of Bakersfield made application to the
Local Agency Formation Commission (LAFCO) to amend its Sphere of Influence (SOl), to add
territory within the Western Rosedale Specific Plan; and
WHEREAS, the proposed amendment is consistent with the existing
Metropolitan Bakersfield 2010 General Plan Land Use Element; and
WHEREAS, the area under consideration has been approved for urban land use
by the County of Kern or is surrounded by property with urban land use designations; and
WHEREAS, the City of Bakersfield is fully capable of providing urban services to
the area and has submitted documentation on the availability of urban services and public
facilities and a written summary of projected capital facilities; and
WHEREAS, this requesl is consistent with several other similar requests
approved by the LAFCO which included territory with both agricultural and urban land use; and
WHEREAS, the reasons given for denial involved the size of the proposed
amendment and a statement that the application was premature, which does not reflect any
review, analysis or discussion of the documentation submitted to LAFCO as required by LAFCO
under State Law and its own policies, standards and procedures; and
WHEREAS, the City Council considered and hereby makes the following
findings:
1. The proposed Sphere of Influence Amendment is consistent with the
Metropolitan Bakersfield 2010 General Plan Land Use Element.
2. The proposal is for territory approved for urban land use and designated
as such in County approved specific plans.
The City of Bakersfield is fully capable of providing the necessary public
services.
4. The decision by LAFCO is inconsistent with past actions on similar
Sphere of Influence amendments.
5. The decision is inconsistent with the Procedures, Standards and Policies
for the Evaluation of Proposals as Promulgated by LAFCO.

6. LAFCO should consider this proposal at the next available meeting by
their Board as pursuant to Government Code Section 56857.
NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Council of the City
of Bakersfield that the City Council hereby requests a reconsideration of Sphere of Influence
Amendment 1-97 by the LAFCO Board.
