This assessment ballot is for the use of the property owner of the parcel(s) identified below,
which parcel(s) is proposed to be included in a City of Bakersfield Traffic Signal Maintenance
District (hereinafter TSMD).
This assessment ballot may be used to express either support for or opposition to inclusion
within a TSMD. In order to be counted, this assessment ballot must be signed below by an
owner or, if the owner is not an individual, by an authorized representative of the owner.

into a Traffic Signal Maintenance District
To Whom It May Concern:
We, the undersigned, as owners of the property included within Lots A ~ B of
Lot- Line Adjustment 03-1225 per Certificate of Compliance 0204038941, Q.R.
.(addresses: 3301 ~ 3425 Panama Lane) hereby request that the property be
included within a Traffic Signal Maintenance District.. This. request is pursuant
to Resolution No.1~1-94 in accordance with Municipal Code Section 13.04.
Enclosed is a check in the. amount of $1,631.30 to cover the costs of inclusion
within the Traf f is Signal Maintenance District. Further, our engineer will supply
you with a disk copy of the map f or your use.
We also waive our right to any and all hearings (whether pursuant to the Brawn
Act, the Bakersfield .Municipal Code, or any other law} concerning the formation
of or inclusion in a maintenance district.
We have signed and are returning the enclosed Proposition 218 ballot (Official
Assessment Ballot) indicating our consent to the assessments.

COVENANT DISCLOSING INCLUSION IN TRAFFIC SIGNAL MAINTENANCE DISTRICT
THIS COVENANT is executed on this ?jp`~' day of November, 2005, by Evergreen-Panama &
Wible, L.L.C., an Arizona limited liability company, (hereinafter, "Owner"}, in connection with the
Traffic Signal Maintenance District TS-No.12, located in the City of Bakersfield, California.
The real property herein described is located within the Traffic Signal Maintenance District TS-
No.12 and may be assessed on an ongoing, yearly basis for maintenance of traffic signals within the
district.
Assessments shall not exceed three thousand dollars ($3,000.00} per traffic signal per year.
Assessments will continue as long as the traffic signals} remain operational at its/their present location.
This covenant may not be amended or modified without the prior approval of the City of
Bakersfield. This covenant shall run with the land.
