A RESOLUTION DETERMINING THAT A
PEDESTRIAN BRIDGE TRUSS FOR MILL CREEK
LINEAR PARK CANNOT BE REASONABLY
OBTAINED THROUGH THE USUAL BIDDING
PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFOR, AND PURCHASE SAID
STRUCTURE FROM CONTECH BRIDGE
SOLUTIONS, INC, IN AN AMOUNT NOT TO
EXCEED $64,000 DOLLARS.
WHEREAS, the City desires to construct and open Phase 1 of the Mill Creek
Linear Park (at Central Park); and
WHEREAS, a Pedestrian Bridge Truss is an integral part of the design for the
Linear Park at Central Park; and
WHEREAS, the City prepared bid documents for the Pedestrian Bridge Truss
but received no bids at the bid opening on April 8, 2008; and
WHEREAS, after receiving no bids, the City contacted at least five (5)
contractors who had shown interest in another similar City bid for pond fence
railing; and
WHEREAS, the City received no response to that inquiry; and
WHEREAS, the City also contacted at least four (4) direct manufacturer
fabricators capable of performing the bridge truss work; and
WHEREAS, the City received one response to that inquiry from Contech Bridge
Solutions, Inc; and
WHEREAS, the pedestrian bridge truss item must be in place 'before the
current out to bid item "Pedestrian Bridge Cover" can be delivered for the project;
and
WHEREAS, the project is time sensitive in nature and requires a date specific
delivery of the pedestrian bridge truss to complete other bid items of work; and
WHEREAS, City staff contacted CONTECH BRIDGE SOLUTIONS, INC. to receive
a quotation to perform the required fabrication of the pedestrian bridge; and

NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The work, supplies, equipment or materials can only be reasonably
obtained from one vendor because of restricted availability of such work, supplies,
equipment or materials, and the delivery date of this fabricated item.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for said work, supplies, equipment or materials
shall not exceed Sixty Four Thousand Dollars ($64,000.00).
