Applicant agrees that if this application is granted, applicant shall indemnify, defend, and hold harmless CITY, its officers, agents and
employees against any and all liability, claims, actions, causes of action or demands whatsoever against them, or any of them, before
administrative or judicial tribunals of any kind whatsoever, arising out of, connected with, or caused by applicant, or in any way arising
from, the terms and provisions of this permit or the placement, use (by applicant or any other person or entity) or maintenance of said
encroachment, whether or not caused in part by a party indemnified hereunder, except for CITY's sole active negligence or willful
misconduct. The applicant further agrees to maintain the aforesaid encroachment during the life of the said encroachment or until such
time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted, or upon revocation thereof by
the City Engineer, applicant will at his own cost and expense remove the same from the public property or right of way where the same is
located, and restore said public property or right of way to the condition as nearly as that in which it was before the placing, erection,
maintenance or existence of said encroachment.
Applicant further agrees to obtain and keep all liability insurance required by the City Engineer in full force and effect for however long
the encroachment remains. Applicant shall furnish the City Risk Manager with a certificate of issuance evidencing sufficient coverage for
bodily injury or property damage liability of both and required endorsements evidencing the insurance required.

1) Starting at existing city wall. Add block wall towards Innisfree (west) approx 6 feet to
the city sidewalk. At sidewalk wall would then turn right following north down Innisfree
approx 52 feet to the edge of the house, A 10 foot wide steel gate would be installed at
the comer column which would parallel Innisfree. This gate is for access to the side area
and would be used to store atv's and a small trailer. The curb cut and driveway entrance
would not be necessary since the gate would only be used on occasion, The gate will be
designed to open in towards the house to not encroach the sidewalk. At the column the
wall would go east towards the house and would line up with the comer of the house. The
front wall would be designed to match the atrium wall at the front of the house. The block
materials used would be similar in color and size to the existing city wall with the
exception of the textured columns.
2) The existing city wall is 81" from the sidewalk level. My house sits above grade and
the existing city wall is not high enough from the ground level at my back yard. This
allows not only the neighboring apartments to the south to view into my back yard but I
can lie in bed at night and see into the windows of the apartments across the street. (North
Half Moon) Note that the apartments also sit above grade. This wall is only 44 to 48" tall
on my side of the wall, To alleviate this problem I have constructed a "garden"
(cedar fence) wall which is the normal 72" from the ground level of my back yard, In
March of this year my family experienced a break in at my property. We were out of
town. The burglars accessed my back yard over this wall and broke into my garage side
entry. They mad~ off with 4 motorcycles, guns, safe, jewelry, computers, tv's ect.
Approx $90,000.00 in all. Rather than move I have decided to make our home a little
more difficult to access, The existing city wall is not tall enough to prevent criminals
from seeing in and climbing over. I would like to add 2 layers of 8" tan block and a 2"
tan cap to the existing city wall from my property line to the east. This "height increase"
would extend to the new proposed wall above thereby making the entire wall the same
height. I then could remove my "garden wall". The wall would be 72" tall at the comer
of the house and approx 99" tall from the sidewalk level.

1) Starting at existing city wall, Add block wall towards Innisfree (west) approx 6 feet to
the city sidewalk. At sidewalk wall would then turn right following north down Innisfree
approx 52 feet to the edge of the house, A 10 foot wide steel gate would be installed at
the comer column which would parallel Innisfree. This gate is for access to the side area
and would be used to store atv's and a small trailer. The curb cut and driveway entrance
would not be necessary since the gate would only be used on occasion. The gate will be
designed to open in towards the house to not encroach the sidewalk. At the column the
wall would go east towards the house and would line up with the comer of the house. The
front wall would be designed to match the atrium wall at the front of the house. The block
materials used would be similar in color and size to the existing city wall with the
exception of the textured columns.
2) The existing city wall is 81" from the sidewalk level. My house sits above grade and
the existing city wall is not high enough from the ground level at my back yard. This
allows not only the neighboring apartments to the south to view into my back yard but I
can lie in bed at night and see into the windows of the apartments across the street. (North
Half Moon) Note that the apartments also sit above grade. This wall is only 44 to 48" tall
on my side of the wall. To alleviate this problem I have constructed a "garden"
(cedar fence) wall which is the normal 72" from the ground level of my back yard. In
March of this year my family experienced a break in at my property, We were out of
town. The burglars accessed my back yard over this wall and broke into my garage side
entry, They made off with 4 motorcycles, guns, safe, jewelry, computers, tv's ect.
Approx $90,000.00 in all. Rather than move I have decided to make our home a little
more difficult to access, The existing city wall is not tall enough to prevent criminals
from seeing in and climbing over, I would like to add 2 layers of 8" tan block and a 2"
tan cap to the existing city wall from my property line to the east. This "height increase"
would extend to the new proposed wall above thereby making the entire wall the same
height. I then could remove my "garden wall", The wall would be 72" tall at the comer
of the house and approx 99" tall from the sidewalk level.
