Applicant agrees that if this application is granted, applicant shall indemnify, defend and hold harmless City, its officers,
agents and employees against any and all liability , claims, actions, causes of action or demands, whatsoever against them,
or any of them, before administrative, quasi-Judicial, or judicial tribunals of any kind whatsoever, arising out of,
connected with, or caused by applicant's placement, erection, use (by applicant or any other person or entity) or
maintenance of said encroachment. The applicant further agrees to maintain the aforesaid encroachment during the life
of said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted, or upon
the revocation thereofbv the City engineer. applicant will at his own cost and expense remove the same from the public
propertv or right of way where the same is located, and restore said public property or right of way to the condition as
nearly as that in which it was before the placing, erection, maintenance or existence of said encroachment.
Applicant further agrees to obtain and keep all liability insurance re'luired by the City Engineer in full force and effect
for however long the encroachment remains. Applicant shall furnish the City Risk Manager with a Certificate of
Insurance evidencing sufficient coverage for bodily mjury or property damage liability or both and required endorsements
evidencing the insurance required. The type(s) and amount(s) of insurance coverage is:

Tract 6016, NW corner of Hageman Road & Riverlakes Drive
Engineering and Traffic staff has reviewed the attached encroachment permit to allow the installation of
the private entrance median within right of way at Hageman Rd. & Porta al Furtezza. The site is located
in the NW corner of Hageman Road and Riverlakes Drive, Tract 6016.
The applicant has provided proof of appropriate insurance coverage to Risk Management, and has
provided signatures of all immediate neighbors stating that they have no objection to the proposed
construction.
Based on their review, staff recommends approval of the permit.

We have investigated a complaint from a. resident of the subject subdivision concerning a safety
issue with both private access gates for the subdivision. one on Hageman Road and one on
Riverlakes Drive. He expressed concerns which he said are echoed by many of the residents in
the home<11WneTS association. Based upon our investigation the following issues need to be
resolved:

t. Hageman Road entrance .- the access keypad is situated at such an acute angle off the
median nose that it forces a driver to swing wide out of the tum lane and tum from
the number tbree through traffic lane. This is unacceptable and could pose
unnecessary exposure to fast moving 55 MPH traffic coming from behind the
entering vehicle. The maneuver is so difficult you can see where the media.n nose has
been strUck several times. The keypad needs to be relocated forward sO the driver can
pull in from the right turn lane and reach it without exiting their vehicle.
2. Riverlakes Drive entrance - the access keypad is situated at a similar angle as the
Hageman entrance so there is no way for a driver to access it without exiting the
vehicle. Furthermore it is sO far forward and the gate so close to the street that a
single passenger vehicle hangs out into tbe: street. The entire: gate and keypad
arrangement need to be modified moving the gate back further and locating the
keypad so it is not askew to the driver and cars don't hang out in10 the street. Perhaps
a sliding gate or some other alternative ;s necessary.
We request you place a hold on certificates of occupancy for any remaining homes until this
matter is resolved. We will also copy in Stuart Patteson to place a hold on any final inspection
releases we may have pending from Public Works, Until these marten; are resolved we
rccomm1md the gates be left open for tbe existing residents.
