OPERATOR IS RESPONSIBLE FOR CALLING THE FIRST NAME ON THE LIST. SECONDLY,
THE ON-SHIFT OPERATOR WILL ENSURE THAT ALL PERSONS ONSITE ARE NOTIFIED AND
EVACUATING TOWARD THE DESIGNATED MEETING POINT OUTSIDE THE GATE. THE FIRST
PERSON ON THE EMERGENCY CONTACT LIST INITIATES THE EMERGENCY RESPONSE
PROCEDURE.
IN THE EVENT OF AN EVACUATION, A PUBLIC ADDRESS SYSTEM WILL BE USED TO
COMMUNICATE INSTRUCTIONS TO PERSONS WITHIN THE FACILITY. ALSO INSTALLED AT
THE FACILITY IS AN EMERGENCY TONE SYSTEM THAT SIGNALS WHAT TYPE OF INCIDENT

OILSPILL PREVENTION, CONTROL, AND COUNTERMEASURE PLAN
1.0 OVERVIEW
1.1 Purpose This plan has been developed to establish procedures, methods,
equipment, and other requirements for equipment to prevent the discharge
of oil into or upon navigable waters of the United States or adjoining
shorelines. The contents of this plan have been prepared to address the
requirements of 40 CFR Part 112. Copies of the plan will be located in
the facility control room and in the administration building environmental
file cabinet.
This SPCC plan conforms with the requirements of 40CFR112.7 and 40
CFR112.8 except as noted on the implementation schedule or here. The
aboveground containers do not undergo integrity testing on a regular
schedule because most storage is in 55-gallon drumsoris contained
within the operating units which provide integral secondary containment
or double walled construction as is the oily wastewater storage tank. The
items listed on the implementation schedule for secondary containment
will be implemented within the time table provided.
1.2 SPCC The SPCC Plan described in the following pages will be valid until
Validation August 27, 2009. The SPCC Plan shall be amended when there is a
change in the facility design, construction, operation, or maintenance that
rrnterially affects the plant's potential fordischarge of oil. All technical
amendments are to be certified by a Professional Engineer (P.E.) and must
be prepared within six months following the material change to the plants
potential fora discharge. The amendment shall be implemented as soon
as possible, but not later than six months following preparation of the
amendment.
This SPCC Plan must be reviewed and evaluated at least once every five
years. The plant manager shall prepare a statement documenting
completion of the review and evaluation and attach it to the Plan
immediately following the titre page. The documentation shall read, "I
have completed review and evaluation of the SPCC Plan forthe Bear
Mountain Limited facility on (date), and will (will not) amend the Plan as

Each area where oil is used or stored has adequate and appropriate
primary spill containment, except as noted on the Implementation
Schedule on page iii. In addition to the secondary containment listed in
Table 1, a 3-inch-high concrete containment bermsurrounds the gas
turbine/generato r package to contain any spills or leaks from the operating
unit. The secondary containment areas do not have drain valves that
might allow the accidental release of spilled oil. Therefore, there is little
potential for discharge of oil due to equipment failure ortankoverfilling.
Precipitation collecting in the containment areas is removed manually or
evaporates quickly. Precipitation is checked visually for signs of oil prior
to removal. If oil is present, the precipitation is collected and disposed of
with the oily wastewater.
The most likely spill scenarios are overturning a 55-gallon drumor
smaller transfer container during materials handling. As a result, the
maximum likely spill outside of secondary containment vwuld be lirrrited
to 55-gallons or less. The spill may occur on either impervious or gravel-
covered surface,and, in either case, is expected to remain within the
immediate area of the spill where the material can ~be contained using
absorbent material. It is not expected that spilled material would reach
off-site drainage. Potential spills from piping, facility transfers, and
delivery trucks are discussed in Sections 2.8 and 2.9.
Any used oil or waste oil, excluding spills and leaks, from the operations
and maintenance of the facility will be recovered for recycling. A supply
ofoil-absorbent material is maintained on site at the oil storage building or
near the operating unit to be spread on any spill to prevent itfrom leaving
the facility area. Materials and equipment are maintained on~site to
remove any accumulated oil in the oil recovery sump within the plant
gravity drain sump. In the event that a spill is not contained by materials,
personnel, or equipment present on site, the local fire department shall be .
contacted foremergency assistance. Bear Mountain Limited shall
procure cleanup contractor(s), as needed. Disposal/recycling of recovered
materials, including, but not limited to, oil-contaminated soil and water
and the absorbent material used in any clean up, will be handled according
to applicable federal, state, and local requirements.
2.6 Plant Drainage The facility is essentially flat with minimal surface gradient.
Approximately 50%ofthefacility is covered by impervious surface
(concrete and asphalt paving) or buildings; the remainder of the facility is
gravel surfaced. Drainage fromthe facility, including storm water, is by
sheet flow; there is not a facility drainage system. Drainage fromthe
entire facility,. including areas where there is potential for oil spills, will
flow to shallow, unlined ditches along the plant perimeter and then to the

plant stormwater retention basin on the east side of the facility. The
drainage basin has the capacity to hold storm water runoff up to a 100-
year flood event and is several hundred times the maximum oil volume
that could be stored on site. The storm water basin will retain any on-site
oil spill that is able to flow away from the oil storage areas, although this
is unlikely due to the secondary containments.
2.7 Storage Tanks All storage tanks are compatible with the material stored. These
storage tanks are also compatible with the conditions of storage such
as pressure and temperature.
• All storage tanks have a primary means of containment in the event of
a spill, except as noted in the Implementation Schedule on page iii and
the oily wastewater tank, which is double-walled . A program to
implement visual interstitial monitoring forthe double-walled oily
wastewater tank will be implemented as part of this SPCC plan so that
this tank meets secondary containment requirements.
• Storage tanks are manually filled with operating personal observing
the filling operation continuously. The storage tanks have direct
reading gauges to monitor tank level.
• Operating personnel observe all tanks daily for signsof corrosion or
leaks that might cause a spill and also monitor for accumulation of oil
inside contained areas. Any loss of oil fromtank seams, gaskets,
rivets, and bolts sufficiently large enough to cause the accumulation of
oil in contained areas will be promptly corrected. The contained areas
are observed to make certain that the containment is intact and that the
containment area can hold the contents of the enclosed tank..
• Storage tank fail-safe engineering features were considered. These
were found impractical since all tanks have orwill be provided a
means of containment in the event of a spill.
• The plant gravity drain sump will be observed daily to detect possible
system upsets that could cause an oil spill event. The source of any oil
observed will be investigated.
2.8 Facility Transfer All aboveground valves, pipelines, and reservoirs are frequently observed
by operating personnel. The general condition of items such as flange
joints, expansion joints, valve glands and bodies, catch pans, pipeline
supports, locking of valves, and metal surfaces are assessed. Any item
needing repair is reported to a supervisorand promptly corrected. In

addition, the above items will be inspected during the annual inspection of
the associated tanks by maintenance personnel.
The transfer of oil within the plant is by pumping through aboveground,
overhead piping, and piping within the operating units. Transfer of used
oil and oily wastewater is by pumping directly from the operating unit into
the used oil (waste oil) tanks ordrums, or by manual transfer using small
(less than 55-gallon) containers. Make-up tube oil is delivered to the
various tube oil tanks and reservoirs by pumping directly from 55-gallon
drums into the tank or reservoir. Piping is contained within the operating
unit (integral containment), immediately outside the operating unit, and
within the primary containment fortheoil storage areas. Any spilled or
leaked material from piping will be contained and cleaned up using
absorbent material and disposed of off site.
2.9 Delivery Truck When tank and delivery trucks unload and load, there is a potential for
Unloading and spills from leaky or broken hoses, leaking drums, faulty fittings, or driver
Disposal Truck error. The driver will be instructed by facility staff as to proper
Loading connect/disconnectprocedures, proper drum handling techniques, and to
drain hoses thoroughly after unloading. A supply of oil absorbent material
will be spread on any spill.
The lowermost drains and valve(s) on delivery trucks are inspected for
leakage before the trucks leave the plant and, if necessary, they are
tightened or adjusted to prevent liquid discharge. Physical interlocks,
wheel chocks, and warning signs are not used to prevent vehicles from
departing. Instead, all transfers are directly overseen by facility personnel
who are trained to respond to a spill or leak.
Loading and unloading areas are on paved surfaces to ensure spill
detection and ease of cleanup. The maximum expected spill from a
delivery will be 55 gallons (the size of a drumdelivered to the site) and
will occur as a single event. The maximum spill from a disposal truck
would be the volume of the disposal truck tank. The typical oily-water
disposal truck volume is 2,300 gallons. Spilled or leaked material will
spread out overthe immediate area, which is flat, and may flow toward
shallow drainage ditches around the facility boundary. Spilled or leaked
material will be cleaned up using absorbent material and disposed of off
site. If spill or leaked material reaches the shallow drainage ditches,
absorbent booms and dirt will be used to dam the ditch to contain the oil
for cleanup.

3.0INSPECTIONS AND PERSONNEL
3.1 Preventative Oil storage tank containment areas and the plant gravity drain sump are

determines if oil has accumulated within the containment area and needs
to be removed and that all equipment is in proper working condition.
Inspections include aboveground valves, piping, and appurtenances,
including joints, valve glands and bodies, catch pans, pipeline supports,
and metal surfaces.
Periodic integrity testing, other than visual inspections, is not performed
or warranted forthe storage containers listed in Table 1 forthefollowing
reasons:
• The outside of all tanks are visible for inspection, except for the
generator tube oil tank within the operating unit and the oily water
storage tank, which is monitored using an interstitial dip stick.
• The tube oil storage drums and turbine tube oil bulk storage drums are
provided with external secondary containment. The natural gas
pipeline condensate (fuel gas by-product) tankwill be provided with
secondary containment as a result of the implementation plan.
• The gas turbine and generator tube oil tanks are reservoirs contained
within the respective operating units, which provide integral secondary
containment for these reservoirs.
• The main and auxiliary~transfomner reservoirs are integral components
of the operating electrical equipment. In addition, the transformers are
provided with external secondary containment.
• The gas compressor tube oil storage tank has been taken out of service.
However, the gas compressor skid has integral secondary containment
forthe skid's operating equipment, including the tube oil storage tank.
• The remaining storage is composed of 55-gallon drums.
In addition, the oily water interstitial space between the tank walls must be
monitored regularly to ensure that failure of the inner tank wall has not
occurred. The oily wastewater tank is equipped with an interstitial dip
stick for monitoring forfailure of the internal tankwall. The tank also is
provided with a direct reading gauge to monitor the volume of material in
the tank.

3.21 nspection and Records of inspections are logged into a Personal Data Computer
Records (PDC) system, and the data maintained on site fora period ofthree years.
The PDC system includes electronic checklists and instructions forthe
inspections.
3.3 Security All storage tanks are located within the fenced plant site, and the
entrance gate is controlled by plant personnel.
• All drain valves and any other valves that will permit direct outward
flow of any tank's contents to the surface are in the closed position
when in non-operating ornon-standby status.
• All drums not directly in use are bunged closed and stored in a
contained area.
• The loading/unloadin g connections of oil reservoirs are capped or
blank-flanged when not in service for an extended time.
The facility has extensive outdoor lighting that assists in the discovery
of leaks and discharges and prevents vandalism. Facility staff is
present 24 hours each day.
3.4 Personnel in ----------------------------------------------------------

4.0 SPILL REPORTING SYSTEM
4.1 Purpose To establish a plant policy forthe reporting of unauthorized discharges of
oil.
4.2 Policy It is the responsibility of the operator when any spill potential exists to do
everything possible to prevent the occurrence of any unauthorized
discharge that could leave plant property and reach a surface stream.
However, should such a spill occur, the plant personnel will take
immediate action with emergency priority until the spill is contained.
4.3 Procedure Any employee becoming aware of an oil spill must contact the plant
supervisory staff immediately and take necessary steps to contain the spill,
as their training allows. Containment and cleanup procedures to be used
by facility staff will consistof deploying absorbent material fromthe spill
kit on and around the spilled material. Empty 55-gallon drums are
available that can be used to hold spent absorbent material.
The employee will notify the plant manager or his designee with the
appropriate details so that the impact of a spill on a receiving stream might
be rrrinimized.

of ivw discharges occurring within any 12-month period, the plant
manager will submit the following information to the U.S. EPA Regional
Administrator and the applicable state agency within 60 days:

• Maximum storage or handling capacity of the facility and normal daily
throughput .

EMERGENCY RELEASE FOLLOW-UP NOTICE
REPORTING FORM INSTRUCTIONS

GENERAL INFORMATION:
Chapter 6.95 of Division 20 of the California Health and Safety Code requires that written
emergency release follow-up notices prepared pursuant to 42 U.S.C. § 11004, be submitted using
this reporting fom~. Non-permitted releases of reportable quantities of Extremely Hazardous
Substances (listed in 40 CFR 355, appendix A) or of chemicals that require release reporting
under section 103(a) of the Comprehensive Environmental Response, Compensation, and
Liability Act of 1960 [42 U.S.C. § 9603(a)] must be reported on the form, as soon as practicable,
but no later than 30 days, following a release. The written follow-up report is required in
addition to the verbal notification.
BASIC INSTRUCTIONS:
• The form, when filled out, reports follow-up infom>3tion required by 42 U.S.C § 11004.
Ensure that all information requested by the form is provided as completely as possible.
• If the incident involves reportable releases of more than one chemical, prepare one report
formforeach chemical released.
• If the incident involves a series of separate releases of chemical(s) at different times, the
releases should be reported on separate reporting fomns.
SPECIFIC INSTRUCTIONS:
Block A: Enter the name of the business and the name and phone number of a contact person
who can provide detailed facility information concerning the release.
Block B: Enter the date of the incident and the time that verbal notification was made to OES.
The OES control number is provided to the caller byOES at the time verbal notification is made.
Enter this control number in the space provided.
Block C: Provide information pertaining to the location where the release occurred. Include the
street address, the city or community, the county and the zip code.
Block D: Provide information concerning the specific chemical that was released. Include the
chemical or trade name and the Chemical Abstract Service (CAS) number. Check all categories
that apply. Provide best available infom~ation on quantity, time and duration of the release.
Block E: Indicate all actions taken to respond to and contain the release as specified in 42 U.S.C.
§ 11004(c).
Block F: Check the categories that apply to the health effects that occurred or could result from
the release. Provide an explanation or description of the effects in the space provided. Use Block
H for additional comments~nformation if necessary to meet requirements specified in 42 U.S.C.
§ 11004(c).
Block G: Include infom~ation on the type of medical attention required for exposure to the
chemical released. Indicate when and howthis infom~tion was made available to individuals
