Dear Ms. Jeanni Loven:
We talked on the phone about your requesting an annual Hazmat business plan update. This is
what I've found after investigating this situation. Nextel of California Inc. has built a cellular
facility at the address listed below, which began commercial operation on 12/28/05.

The land that this site was built on was lea~gai"ar Wireless Inc., who also has a
cellular facility at this address. You stated that the hazardous materials were reported in 2000.
These materials cannot be Nextel's because we just finished building our facility, and additionally,
we do not use any batteries weighing only 20 Ibs nor has a Halon system been installed.
believe that the materials you have in your system are the ones that Cingular Wireless reported.
am the only one person at Nextel of California Inc who will correspond with your jurisdiction on
matters of Hazardous Materials. The only correspondence that I have sent for this facility was
.dated 01 /06/06 and requested exemption from submitting a business plan because we are under
your reporting thresholds. Is it possible that the woman who sent the letter requesting the billing
address changes was from Cingular, not Nextel? If Cingular was receiving invoices for Nextel
facilities, someone from there would have reason to request these changes and they would be
familiar.enough with Nextel to provide the contact information as found on that update form.
would like to work with you to verify that the updates .were made to the right facilities, otherwise
future invoices may become past due because the wrong company got billed.
At the moment Nextel is waiting for the power company to install a power meter for our new
facility. A generator has been rented to power the facility on a temporary basis, and it will be
removed after the installation of the power meter. There is currently no plan to place a generator
at this facility despite our construction drawings showing that we have leased & zoned extra
space for it -this was done in case there might be a future need for a generator.
Nextel will not be submitting a business plan at this time because none of the reportable
hazardous materials exceed your thresholds, and therefore we consider this facility exempt fr m
business plan submission. Please respond by correspondence or email if you disagree.
