A RESOLUTION TO INCREASE ASSESSMENTS FOR A
PORTION OF AREA 2-01 (VINEYARDS) WITHIN THE
CONSOLIDATED MAINTENANCE DISTRICT, CONFIRMING
THE ASSESSMENTS, APPROVING THE PUBLIC WORKS
DIRECTOR'S REPORT, AUTHORIZING COLLECTION OF
ASSESSMENTS BY THE KERN COUNTY TAX COLLECTOR
AND TERMINATING AGREEMENT NO. 93-132. (WARD 5)
WHEREAS, On July 7, 1993, the City of Bakersfield ("City") and Vineyards
Community Association, Inc., ("Association") entered into Agreement No. 93-132,
delegating maintenance responsibilities for certain landscape areas to the Association in
exchange for reduced maintenance district assessments; and,
WHEREAS, City has received a letter from Association requesting that this
agreement be terminated; and,
WHEREAS, termination of the agreement would require an increase in
assessments to the parcels within the Association; and,
WHEREAS, Proposition 218 requires that any increase in assessments
requires a vote of the owners of the affected parcels; and,
WHEREAS, the City Council of the City of Bakersfield, State of California,
heretofore by Resolution of Intention No. 1238, adopted Mamh 14, 2001 declared its
intention to increase assessments for parcels within that portion of Area 2-01 of the
Consolidated Maintenance District, known as the Vineyards, preliminarily confirmed and
approved the Public Works Director's Report and the amount of assessment to be levied
against each parcel as shown and designated on that certain map entitled Map and
Assessment Diagram for Increased Assessments, Area 2-01 (Vineyards), Within the
Consolidated Maintenance District, Bakersfield, California; and,
WHEREAS, the Public Works Director duly filed with the City Clerk his
Report, including a description of property and increased assessments; and,
WHEREAS, the City of Bakersfield has provided notices and sent ballots to
each property owner of record within that portion of Area 2-01 of the Consolidated
Maintenance District, known as the Vineyards, in compliance with Proposition 218, the
Brown Act and the Bakersfield Municipal Code concerning the increase in assessments.
NOW THEREFORE, BE IT RESOLVED by the City Council of the City of
Bakersfield, State of California, as follows:
1. The foregoing recitals are true and correct and are incorporated
herein.
2. This Council finds and determines that, for purposes of the majority
protest provisions of Section 53753 of the California Government Code, the assessment
ballots signed and returned to the City Clerk prior to the close of the public hearing on May
16, 2001 do not constitute a majority protest.
3. The council hereby increases the annual assessments of those
parcels within that portion of Area 2-01 of the Consolidated Maintenance District, known
as the Vineyards to $57.14 per parcel, and confirms and adopts the Public Works Directors
Report (attached hereto as Exhibit 1 and incorporated herein by reference).
4. The Council hereby terminates Agreement No. 93-132, dated July 7,
1993, between the City of Bakersfield and Vineyards Community Association, Inc.,
effective July 1,2001.

INCREASE ASSESSMENTS
Portion of Area 2-01 (Vineyards)
Fiscal Year 2001-2002
That portion of Area 2-01 (Parkside Village), known as Vineyards, is a part
of the Consolidated Maintenance District, and is generally described as an area bounded
by Kroll Way on the north, Gosford Road on the east, Camino Media on the south, and a
line 1040 feet west of Gosford Road on the west, and as specifically shown on Map and
Assessment Diagram marked Exhibit "B," attached hereto and incorporated herein by
reference as though fully set forth, as an area within the City of Bakersfield.
Pursuant to the provisions of Chapter 13.04 of Title 13 of the Municipal Code
of the City of Bakersfield, referred to as the Maintenance District Procedure, the Public
Works Director makes and files this Report and proposed increased assessments of and
upon all parcels of property within the area described above for the cost of maintaining
street and median landscaping improvements, The improvements generally include,
but are not limited to, plant forms, irrigation system pipes, conduits, water mains and/or
sprinkler systems therefore, planting, including turf, shrubs, ground covers and trees now
existing or hereafter to be installed or planted in and for said area and are of a public
nature. The assessment includes the cost of necessary repairs, replacement, water,
electricity, care, supervision and any and all other items necessary for the proper
maintenance and operation thereof, and all additions and improvements thereto which may
hereafter be made.
On July 7, 1993 the City of Bakersfield and Vineyards Community
Association, Inc., entered into Agreement No. 93-132 delegating a portion of maintenance
responsibilities for street landscape areas to the Association in exchange for reduced
maintenance district assessments. These areas are along the south side of Kroll Way,
west side of Gosford Road and north side of Camino Media, adjacent to the Vineyards.
On August 24, 2000, the Association requested that this agreement be terminated and the
previously delegated maintenance responsibilities be returned to the City. In order for the
City to terminate the agreement and assume maintenance responsibilities, assessments
must be increased. Proposition 218 requires a vote of the affected property owners before
assessments can be increased.
Assessments within this area will increase from the current $11.54 (tier 0.5
for median landscaping only) to $57.14 (tier 2.5 for median and extra wide street
landscaping) per single family residence. Increased assessments will be assessed
beginning with the 2001-2002 fiscal year as set forth in Exhibit "E".
Public street and median landscaping benefits all the lots or parcels and is assessed

on an Equivalent Dwelling Unit basis throughout the area. The Benefit Formula is set forth
herein as Exhibit"C" and attached hereto and incorporated in this resolution as though fully
set forth herein.
NOW THEREFORE, I, JACQUES R. LAROCHELLE, Interim Director of
Public Works of the City of Bakersfield, by virtue of the power vested in me and the order
of the Council of said City, hereby submit the Fiscal Year 2001-2002 Budget and
Assessment Roll as set forth in Exhibit "D" and Exhibit "E," respectively, attached hereto
and incorporated herein as though fully set forth, upon all parcels of property within that
portion of Area 2-01, (Parkside Village) known as Vineyards, subject to be assessed to pay
the cost of maintenance and operation in said area.

LEGAL DESCRIPTION
Portion of Area 2-01 (Vineyards)
A parcel of land situated in the City of Bakersfield, County of Kern, State of California,
being a portion of Section 5, T 30 S, R 27 E, M. D. B. & M., and more particularly described
as follows:
Beginning at a point on the east line of said Section 5 being the intersection of the
centerlines of Gosford Road and Kroll Way;
THENCE (1) Southerly along said east line and centerline a distance of 1980 feet;
more or less, to intersect the centerline of Camino Media;
THENCE (2) Westerly along said centedine of Camino Media, through various
courses, a distance of 1200 feet, more or less, to intersect the southerly
prolongation of Lot 11 of Tract No. 4568, Unit 4;.
THENCE (3) Northerly, along said west line and southerly prolongation thereof, and
the west line of Tract No. 4568 Unit 4, Tract No. 4568 Unit 1 and Tract No. 4568
Unit 2 and northerly prolongation thereof to intersect the centerline of Kroll Way;
THENCE (4) Easterly, along said centerline of Kroll Way, through various courses,
a distance of 1050 feet, more or less, to intersect the centerline of Gosford Road

Each parcel in the Street Landscaping Zone of Benefit shall be assessed the
amount as defined in (1) below:

the amounts as defined in (1) and (2) below:
