Visit Number 1 by the Bakersfield Fire Marshal's office: Comment from the inspector, Mr. Gary Lowery, "I don't know if you can even store explosives here. " Fire Prevention Inspector Gary Lowery informed Mr. Gary Corbell of Welenco Inc. he would have to investigate the legalities of handling and storing explosives at the address of 5201 Woodmere Drive. 4. isit Number 2 by the Bakersfield Fire Marshal's office: Comment from the inspector, Mr. Gary Lowery, "Up to 50 pounds of explosives must be stored 60 feet from your property line. " Gary spoke to Mr. Corbell and quoted the Uniform Building Code, Chapter 5, Section 503.4.5 which stated Group H, Division 1 Occupancies, not less than 75 feet and not less than required by Table 3-.F, distance from property line. Gary stated a maximum 50 pounds of explosives which he referenced from the Uniform Fire Code, Article 77, Section 7702.3.10. (See attached of code.) Explosive Storage Page 2 December 2, 1998 S. Visit Number 3 by the Bakersfield Fire Marshal's office: The inspector, Mr. Gary Lowery, delivers the first "Notice of Violation." Gary and I delivered a "Notice of Violation" to Mr. Corbell at 5201 Woodmere Drive. 6. Vsit Number 4 by the Bakersfield Fire Marshal's office: Comment from a different inspector, Mr. Steve Holland, "I don't know where the 60 feet designation came from. However, if the BATF approves the storage, the Bakersfield Fire Department will approve it. " I stated if BATF has reference concerning explosives and was similar with what the City enforces, it maybe considered by the Bakersfield Fire Department Fire Marshal. 7. A call from the Bakersfield Fire Marshal's office: Comment from the inspector, Mr. Steve Holland, "We have asked the BATF for written confirmation of compliances " I made contact with Mr. Don Pruett of BATF. He stated the Distance Table 3-F does not apply to storage of explosives indoors. I did not interpret BAFT's code in this same manner. The Bakersfield Fire Department's code supercedes BAFT's. 8. A call from the Bakersfield Fire Marshal's office: Comment from the inspector, Mr. Steve Holland, "Even if the BATF reports you are in compliance, we have found other violations to the codes" Other examples of violations found within the Uniform Fire and Building Code at Welcenco Inc. are sprinkler requirements which are limited to one story and property line distance. 9. Call from the Bakersfield Fire Marshal's office: Comment from the inspector, Mr. Steve Holland, "You will receive a demand to remove the explosive on Monday, November 2, 1998." This was the second Notice of Violation. I telephoned Mr. Corbell and informed him it was determined there were no exceptions in the Uniform Fire Code and Uniform Building Code regarding this Explosive Storage Page 3 December 2, 1998 storage of explosives. 10. Mayor Price stating, "It is probably because Welenco changed addresses " However, the Fire Marshal has inspected Halliburton and possibly other businesses that have not moved Also, Price stated, "He would get back with me. " That courtesy was not forthcoming, but I wasn't surprised Mr. Pruett from BATF speculated Halliburton Energy Services, located at So. Union Avenue and So. Chester Avenue, does not meet the Uniform Fire Code. I made an inspection to Halliburton Energy Services and found this to be true. I discovered one of the two buildings does not have a sprinkler system nor meets the Properly Distance Table requirements. This inspection is still continuing. When a new building is to be erected on the same property as an existing building, the location of the assumed property line with relation to the existing building shall be such that the exterior wall and opening protection of the existing building meet the criteria as set forth in Table 5-A and Chap- ter 6. ~ EXCEPTION: Two or more buildings on the same property may be considered as portions of one building if the aggregate area of such buildings is within the limits specified in Section 504 for a single building. When the buildings so considered house different occupancies or are of different types of conswction, the area shall be that allowed for the most restricted occupancy or conswction. 503.4 Special Provisions and Exceptions to Table 5-A. 503.4.1 General. The provisions of this section are exceptions to, or special provisions of, the construction requirements of Table 5-A, Chapters 3 and 6. 503.4.2 One-story Groups B, F, M and S Occupancies. In Groups B, F, M and S Occupancies, a fire-resistive time period will not be required for an exterior wall of aone-story, Type II-N building, provided the floor area of the building does not exceed 1,000 square feet (93 m) and such wall is located not less than 5 feet (1524 mm) from a property line. 503.4.3 Fire-retardant-treated wood framing. In Types III and N construction, approved fire-retardant-treated wood framing may be used within the assembly of exterior walls when Table 5-A allows afire-resistive rating of two hours or less provided the required fire resistance is main- tained and the exposed outer and inner faces of such walls are noncombustible. •~• (' 503.4.4 Wood columns and arches. In Types III and N construction, wood columns and arches conforming to heavy-timber sizes may be used externally when exterior walls are permitted to be unprotected, noncombustible construction or when one-hour fire-resistive noncombustible exteri- or walls are permitted. 503.4.5 Group HOccupancies-minimum distance to property lines. Regardless of any other provisions, Group H Occupancies shall be set back a minimum distance from property lines as set forth in Items 1 through 4 below. Distances shall be measured from the walls enclosing the occupan- cy to all property lines, including those on a public way. 1. Group H, Division 1 Occupancies. Not less than 75 feet (22 860 mm) and not less than re- quired by Table 3-F. C 2. Group H, Divisions 2 and 3 Occupancies. Not less than 30 feet (9144 mm) when the area of the cccupancy exceeds 1,000 square feet (93 m2) and it is not required to be located in a detached bt:ild- ing. 3. Group H, Divisions 2 and 3 Occupancies. Not less than 50 feet (15 240 mm) when a detached building is required. See Table 3-F. 4. Group H, Divisions 2 and 3 Occupancies containing materials with explosive characteristics. i/ Not less than the distances required by Table 3-F. ~ 503.4.6 Group H, Division 1, 2 or 3Occupancies-detached buildings. When a detached building is required by Table 3-G, there are no requirements for wall and opening protection based on location on property. 503A.7 Group H, Division 4 Occupancies. Group H, Division 4 Occupancies having a floor area not exceeding 2,500 square feet (232 m2) may have exterior bearing walls of not less than two-hour fire-resistive construction when -ess than 5 feet (1524 mm) from a property line, and not less than one hour when less than 20 feet (6096 mm) to a property line. 503A.8 Group U, Division 1 Occupancies. Indoor magazines constructed of metal shall have sides, bottoms and lids or doors constructed of not less than 0.097-inch (2.5 mm) (12 gage) steel and shall be lined with a minimum of I/~-inch (12.7 mm) of nonsparking material. EXCEPTION: Type 5 indoor magazines used for the storage of blasting agents (Explosives, Division 1.5-see Appendix VI-E) need not be fire resistant. Indoor magazines need not be bullet resistant or weather resistant if the buildings in which they are stored provide protection from the weather and bullet penetration. Hinges and hasps shall be attached to doors or lids by welding, riveting or bolting with nuts on the inside so that doors or lids cannot be removed when closed and locked. Each magazine shall be equipped with a steel padlock, which need not be protected by a steel hood, having at least five tumblers with acase-hardened shackle of at least 3/g-inch (9.5 mm) diam- eter. Indoor magazines shall have substantial wheels or casters to facilitate removal from a building in case of emergency. Magazines shalt be painted red and the lid or door shall bear in conspicuous white lettering, at least 3 inches (76.2 mm) high, EXPLOSIVES-KEEP FIRE AWAY. The indoor storage of high explosives shall not exceed 50 pounds (22.7 kg). Detonators shall be stored in a separate magazine from other explosive materials and the total number of detonators stored shall not exceed 5,000. Indoor magazines containing blasting agents in excess of 50 pounds (22.7 kg) shall be located in accordance with nationally recognized standards. (See Appendix VI-E.) Indoor storage magazines shall not be located in residences or dwellings. SECTION 7703 -USE, HANDLING AND TRANSPORTATION 7703.1 Use and Handling. 7703.1.1 Hours of operation. Blasting operations shall be conducted during daylight hours. EXCEPTION: When other times aze approved by the chief. 7703.1.2 Personnel qualifications. The person in charge of the handling and use of explosive materials shall be at least 21 years of age and possess a valid explosive-use permit issued by the chief. EXCEPTION: Persons l8 yeazs of age or older are allowed to use and handle explosive materials under the direct personal supervision of a person who possesses a valid explosive-use permit. ' 7703.1.3 Intoxicants. Explosive materials shall not be handled by persons under the influence of intoxicants, narcotics or DEA-controlled substances. 7703.1.4 Smoking. Smoking and carrying matches while handling explosive materials or while within 50 feet (15 240 mm) of where explosive materials are being used are prohibited. 7703.1.5 Sources of ignition. The use of matches, lighters, spark-producing devices or the ~ , presence of any open flames is prohibited within 50 feet (15 240 mm) of areas where explosives aze ~• being used. EXCEPTION: The lighting of safety fuse in conjunction with approved blasting operations. 7703.1.6 Utilities notification. When blasting is being conducted in the vicinity of gas, electric, water, fire alarm, telephone, telegraph or stream utilities, the blaster shall notify the appropriate rep- resentative of such utilities at least 24 hours in advance of blasting specifying the location and in- ~ :} tended time of such blasting.
