HomeMy WebLinkAboutORD NO 3871ORDINANCE NO. 3 8 7 I AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE AND ZONING MAP NO. 102-34 BY CHANGING THE ZONING OF 5.27 ACRES GENERALLY LOCATED 5700 STOCKDALE HIGHWAY FROM A PCD (PLANNED COMMERCIAL DEVELOPMENT) TO C-2 (REGIONAL COMMERCIAL) ZONE. (P98-0615) WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held a public hearing on a petition to change the land use zoning of those certain properties in the City of Bakersfield generally located 5700 Stockdale Highway; and WHEREAS, by Resolution No.103-98 on September 17, 1998 the Planning Commission recommended approval and adoption of an ordinance amending Title 17 of the Municipal Code to approve a C-2 (Regional Commercial) zone as delineated on attached Zoning Map No. 102-34 marked Exhibit "B", by this Council and this Council has fully considered the recommendations made by the Planning Commission as set forth in that Resolution: and WHEREAS, Ihe Planning Commission, as a result of said hearing, did make several general and specific findings of fact which warranted a negative declaration of environmental impact and changes in zoning of the subject property from PCD (Planned Commercial Development) to a C-2 (Regional Commercial) zone and the Council has considered said findings and all appear to be true and correct; and WHEREAS, the law and regulations relating to the preparation and adoption of Negative Declarations, as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff, Planning Commission and this Council; and WHEREAS, a Negative Declaration was previously adopted on May 6, 1998 for related General Plan Amendment and concurrent Zone Change No. P97-0888 in accordance with CEQA: and WHEREAS, the general plan designation for this area allows commercial development: and WHEREAS, the property owners of the adjacent Stockdale Village Shopping Center have recently acquired ownership of the subject site and desire to integrate the subject site as part of the existing Stockdale Village Shopping Center; and WHEREAS, the City Council has considered and hereby makes the following findings: 1. All required notices have been given. been followed. The provisions of the California Environmental Quality Act (CEQA) have Pursuant to CEQA Section 15162, no additional environmental analysis is needed for this project. 4 The project will not have a significant effect on the environment. 5. Conditions of approval as shown on attached Exhibit "A" are included in the project to mitigate impacts. SECTION 1. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: 1. All of the foregoing recitals are hereby found to be true and correct. 2. The Negative Declaration previously approved and adopted for related project P98-0888 is adequate. 3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of that certain property in said City, the boundaries of which property is shown on Zoning Map. No. 102-34 marked Exhibit "B" attached hereto and made a part hereof, and are more specifically described in attached Exhibit "C ". 4. Such zone change is hereby made subject to the conditions of approval listed in attached Exhibit "A". SECTION 2. This ordinance shall be posted in accordance with the Bakersfield Municipal Code and shall become effective not less than thirty (30) days from and after the date of its passage. ......... o0o ......... In addition to local mitigation described in subsequent conditions this project shall still be required to pay the Phase II Regional Traffic Impact fees (RTIF) per the fee schedule established by the City Council. The signalized entrance shall be located to align with the Post Office access. With construction of the signalized entrance, the existing median opening approximately 550' west of New Stine Road shall be closed. Two right turn deceleration lanes shall be dedicated and constructed at the following locations: 3.1 At the proposed signalized intersection; and 3.2 At the new entrance located west of the proposed signal. Interconnect will be required with the design and construction of the proposed traffic signal and street improvements. Prior to issuance of a building permit, 5.1 A signal synchronization study shall be submitted to include all signals on Stockdale Highway from Reap Road to the Town and Country signal west of Gosford Road. 5.2 The property owner shall provide dedication for the required deceleration lanes. 5.3 The applicant shall submit all street improvement plans, including signal and median modification plans, to the city engineer for review and approval. Plan check and inspection fees shall be submitted with the first improvement plan submittal. Fees will be based on the engineer's estimated costs of improvements. 5.4 The applicant shall submit to the city engineer for his review and approval a separate engineer's estimate for the project's share of mitigation mentioned below. 6 Project share of mitigation - Intersections. The following intersections were identified as requiring mitigation beyond that provided for by the RTIF program due to expected growth. In no case does the addition of project further degrade the Level of Service once the mitigation is in place. The applicant shall pay the proportionate share of the cost of these improvements. The costs shall be based upon approved estimates prepared by the project engineer. Stockdale Highway at California Avenue/New Stine Road 2.07% (Add dedicated eastbound and northbound right turn lanes, modify signal to provide southbound right turn overlap) Stockdale Highway at Gosford Road 0.41% (Widen intersection to full expansion per City standards) Stockdale Highway at Real Road 0.51% (Add dedicated northbound and southbound right turn lanes) P:\Z\615\exA-cc wpd October 7, 1998 Exhibit "A" ZC P98~0615 Page 2 Upon issuance of the first building permit, the following fees shall be paid: 7.1 the above-mentioned project share of mitigation. 7.2 sewer connection fees paid at the rate in effect at the time of issuance of the permit. 7.3 regional treffic impact fee. The developer shall either provide median island landscaping or, prior to approval of improvement plans, pay the proportionate share of the costs for median island landscaping. The site shall be included within the consolidated maintenance district, and the developer shall pay all required costs and provide all required information. 10. A street permit shall be obtained from the City Engineer prior to any construction within public rights of way. A deposit in the amount of the estimated costs of the improvements shall be posted prior to issuance of the street permit. 11. All street improvements, including signal installation and turn-on, shall be completed by the developer prior to occupancy of any structure. PLANNING 12. If during construction activities or ground disturbance, cultural resources are uncovered, the subdivider shall stop work and retain a qualified archeologist for further study. Subdivider shall notify the proper authorities and be subject to any mitigation measures required of the archeologist. 13. Approved landscaping and parking shall be installed and inspected before final occupancy of any building or site. Inspections are made on Fridays. A landscape strip at a minimum width of 10 feet shall be provided along the west and north boundaries adjacent the wall. Minimum size 24 inch box evergreen trees shall be used along the western and northern boundary of the site. Larger trees (minimum 36 inch box ) evergreen trees shall be strategically placed along the west property line adjacent the apartments to mitigate visual exposure from the parking lot. 13.1.b There shall be a minimum 10 foot wide landscape strip along the Stockdale Highway frontage. Landscape material shall meet the minimum requirements of Section 17.53.061. 14 A solid masonry wall is required to be constructed adjacent to residentially zoned property by the Bakersfield Municipal Code (Section 17.24.050D.) as follows. This wall must be shown on the final plans and constructed a minimum height of 7 feet as measured from the highest adjacent finished grade along the west boundary of the property. A minimum 6 foot high masonry wall shall be constructed along the northern boundary of the site adjacent the school. P:~\615\exA-cc.wpd October 7, 1998 Exhibit "A" ZC P98-0615 Page 3 15. The following site plan review conditions approved for Savemart as part of GPA/ZC PCD #98- 0888 still apply to the construction of the Savemart supermarket. The following site plan review conditions are use specific and may change with a change of use on the site. Site Plan Review Conditions P98-0888 (SaveMart Site) The following are specific items that the Site Plan Review Committee has noted that you need to resolve before you can obtain a building permit or be allowed occupancy. These items may include changes or additions that need to be shown on the final building plans, alert you to specific fees, and/or are comments that will help you in complying with the c/ty's development standards. Each item will note when it is to be completed and they have been grouped by department so that you know who to contact if you have questions. Building Department: 15.1 The applicant shall submit 4 copies of grading plans and 2 copies of the preliminary soils report to the Building Division. You must submit a final soils report to the Building Division before they can issue a building permit. 15.2. The applicant shall include fire resistive wall construction details with the final building plans for all exterior walls of any building that are within 20' of property lines if it is commercial, or 5' of property lines if it is residential. 15.3. Include with the final site plan documentation or changes to the plan showing that the project complies with all disability requirements of Title 24 of the State Building Code. 15.4. The applicant shall obtain all required approvals from the Kern County Environmental Health Services Department (2700 "M" Street, Bakersfield, CA; Ph. 805/862-8700) for any food handling facility, (ie. market, delicatessen, care, concession, restaurant) before building permits can be issued. 15.5. Structures exceeding 10,000 square feet in area shall be constructed to include an automatic fire sprinkler system. 15.6. Business identification signs are not considered nor approved under this review. A separate review and sign permit from the Building Division is required for all new signs, including future use and construction signs. Signs must comply with the Sign Ordinance. 15.9. The Building Division will assess school district fees at the time they issue a building permit. Planning Department: 15.10. REQUIRED PARKING: 164 spaces 15.11 15.12 15.13 15.14 15.15 The applicant shall submit one (1) copy of a landscape and specification for irrigation to the Planning Division, and include a copy of these plans with each set of the final plans submitted for building permits. Landscaping shall meet the standards of the Bakersfield Municipal Code (Section 17.53.061 - attached). Building permits will not be issued until the Planning Department has approved the landscape plan for consistency with minimum ordinance standards. Parking lot lighting is required by the Bakersfield Municipal Code (Section 17.58.060A). Lights shall be designed, arranged, and shielded to reflect light away from adjacent residential properties and streets. All light fixtures shall be between 15' and 40' above grade with illumination evenly distributed across the parking area. Lighting direction and type of light fixture shall be shown on the final site plan or included with the building plans. Our records show your project is contained on more than one parcel. Please provide evidence that the parcels have been merged into a single lot. Evidence of a legal lot merger shall be one of the following: 15.13.a Provide a copy of a grant deed recorded before March 4, 1972 where the legal description identifies all associated parcels as one lot. (Note: Assessor's parcel information is not acceptable since the Assessor does verify legality of lots.) 15.13.b. Provide a copy of a recorded parcel map, subdivision map, or certificate of compliance showing the property as one lot. The applicant shall file with the Planning Division a copy of a recorded map or other instrument that ensures that drive aisles, parking, and access is shared in common with adjoining properties. Rooftop areas of commercial buildings (eg. office, retail, restaurant, assembly, hotel, hospital, church, school) shall be completely screened by parapets or other finished architectural features constructed to a height of the highest equipment, unfinished structural element or unfinished architectural feature of the building. Spacing between each sign identifying the fire lane must also be shown on the final plan that meets minimum city standards. The applicant shall install all required fire lane signs before occupancy of any building or portion of any building is allowed. 15.17. Show on the final site plan all on-site fire hydrant locations and required fire flows. Based upon available information, the fire flow requirement may be 3,500 gallons per minute. 15.18 To provide adequate fire protection during construction, the applicant shall install four fire hydrant(s) as required by the Fire Dept., or provide an alternative fire suppression program as approved by the Fire Department before final site plan approval. The applicant is required to purchase all fire hydrants from the Fire Department. 15.19. The applicant shall give the Fire Department one set of the engineered water plans before the issuance of any building permit. 15.20. The applicant shall contact the Fire Safety Control Division, (1715 Chester Avenue, Suite 300, Bakersfield, CA; Ph. 805/326~3951) for fire and safety requirements. Please provide one (1) site plan and one (1) floor plan to the Fire Marshal before beginning construction. Staff will also issue guidelines for automatic sprinkler system fire department connections (FDC) if sprinkler systems are required. 15.21 The applicant must request an inspection of any underground sprinkler feeds at least 24 hours before they are buried. The Fire Safety Control Division (1715 Chester Avenue, Suite 300, Bakersfield, CA; Ph. 805/326-3951) must complete all on-site inspections of fire sprinkler systems and fire alarm systems before any building is occupied. 15.22. All streets and access roads to and around any building under construction must be at least 20 feet wide, contain no vehicle obstructions, and be graded to prevent water ponding. Barricades must be placed where ditches and barriers exist in or cross roadways. Emergency vehicle access must always be reliable. 15.23. Yellow stripes shall identify areas next to all Fire Department connections according to the Bakersfield Municipal Code (Section 15.64.140 d.). Traffic Engineering: 15.24 Length dimension for parking stall is insufficient for alignment shown. Change to 23.2' minimum. Changing parking alignment to interlocking module as shown on City of Bakersfield Standard T-10 is suggested. 15.25 Parking spaces parallel to west property line shall be 9' x 22' minimum. Before occupancy of the building or site is allowed, four, three cubic yard front loading type refuse bin(s) shall be constructed on the site according to the adopted city standards (Detail #S-43). 15.27. Show on the final plan one compactor roll-off bin location(s). 15.28 Before building permits can be issued or work begins on the property, you must contact the staff person above to establish the level and type of service necessary for the collection of refuse and/or recycled materials. 15.29. Facilities that require infectious waste services shall obtain approval for separate infectious waste storage areas from the Kern County Health Department. In no instances shall the refuse bin area be used for infectious waste containment purposes. 15.30. Facilities that require grease containment must provide a storage location that is separate from the refuse bin location. 15.31. Facilities that participate in recycling operations must provide a location that is separate from the refuse containment area. 15.32. The Solid Waste Division will determine appropriate service levels for refuse collection required for a project. The levels of service are based on how often collection occurs as follows: Can or cart service -- Front loader bin service -- Roll-off compactor service -- 1 cubic yard/week or less I cubic yard/week - 12 cubic yards/day More than 12 cubic yards/day 16. The following site plan review conditions approved as part of Site Plan Review #P98-0483 for the 2,100 square feet of commercial retail space located on the east side of the Savemart apply to said 2,100 square foot building. All driveways, vehicular access and parking areas shall be paved with a minimum of 2" Type B, A.C. over 3" Class II A.B. according to the Bakersfield Municipal Code (Section 15.76.020 & 17.58.050 N.) and the adopted standards of the City Engineer. 16.19. Before you occupy any building or site, you must reconstruct or repair substandard off- site improvements to adopted city standards as directed by the City Engineer. Please call the construction superintendent at 805/326-3049 to find out what improvements will be required. 16.20. The Public Works Department will require you to obtain a street permit before any work can be done within the public right-of-way (streets, alleys, easements). You must submit a copy of this site plan review decision to the Public Works Department at the time you apply for the street permit. 16.21 A sewer connection fee shall be paid at the time a building permit is issued. We will base this fee at the rate in effect at the time a building permit is issued. 16.22 A transportation impact fee for regional facilities shall be paid at the time a building permit is issued, or if no building permit is required, before occupancy of the building or site. This fee will be based at the rate in effect at the time the permit is issued. Based on the fee schedule in effect for the 1998-1999 fiscal year and the proposed use, the rate would be $35 for each vehicular trip. The Public Works Department will calculate an estimate of the total fee when you submit construction plans for the project.
