AN ORDINANCE ADDING AND AMENDING SECTIONS
OF TITLE 17 OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO LOT SIZES AND ON-SITE PARK LIKE
AMENITIES FOR MULTIPLE-FAMILY PROJECTS WITH
FOUR OR LESS UNITS
WHEREAS, the City Council, through its Secretary, did set, WEDNESDAY,
NOVEMBER 4, 1998, at the hour of 7:00 p.m. in the Council Chambers of City Hall, 1501
Truxtun Avenue, Bakersfield, California, as the time and place for a public hearing before said
City Council on said ordinance, and notice of the public hearing was given in the manner
provided in Title Seventeen of the Bakersfield Municipal Code; and
WHEREAS, the ordinance was found to be exempt from the provisions of CEQA
and the law and regulations as set forth in CEQA and City of Bakersfield's CEQA
Implementation Procedures, have been duly followed by city staff and the Planning
Commission; and
WHEREAS, the City Council referred to the Planning Commission for review and
recommendation the matter of design, location, and lack of amenities for multi-family dwellings
with four units or less: and
WHEREAS, over the course of several months the Subdivision and Public
Services Committee of the Planning Commission met with representatives from the Building
Industry, Realtors and the general public regarding the Council referral: and
WHEREAS, the Urban Development Committee of the City Council has reviewed
the recommendations and directed staff to prepare the recommendations for public hearing; and
WHEREAS, the Planning Commission, through its Secretary, did set, MONDAY,
SEPTEMBER 14, 1998, and THURSDAY, SEPTEMBER 17, 1998, at the hour of 5:30 p.m in
the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time
and place for a public hearing before said Planning Commission on said ordinance, and notice
of the public hearing was given in the manner provided in Title Seventeen of the Bakersfield
Municipal Code; and
WHEREAS, at said public hearing, the amendments were duly heard and
considered and the Planning Commission recommended their adoption by to City Council.
NOW, THEREFORE, BE IT HEREBY ORDAINED by the City Council of the City
of Bakersfield as follows:
1. That the text additions and amendments to Title 17 of the Bakersfield
Municipal Code are hereby approved as follows:
SECTION I
Subsection C is hereby added to section 17.14.040 C to read as follows:
17.14.040 Front yard.
C. For multi-family dwellings with four units or less front yard setbacks shall be a
minimum of 15 feet and shall have an average setback of twenty feet or every third lot shall
have a front yard setback of twenty feet.
SECTION 2
Section 17.04.070 is hereby amended to read as follows:
17.14.070 Minimum lot area.
A. For multiple-family dwellings with five units or more per lot the minimum
lot area shall be not less than six thousand square feet, and the minimum lot area shall be not
less than two thousand five hundred square feet per dwelling unit. When a nonconforming tot
has less than six thousand square feet and was recorded in the office of the county recorder at
the time of the passage of the ordinance codified in this section, said lot may be occupied by not
more than one dwelling unit for each two thousand five hundred square feet.
B. For multiple-family dwellings with four units or less, the minimum lot area
shall be based on a floor area ratio of .25, and the minimum lot area per unit shall be not less
than two thousand five hundred square feet per dwelling unit.
C. Minimum lot area for multiple-family dwellings with four units or less or
approved four-plex subdivisions with onsite amenities consisting of playground apparatus,
outdoor public court yards with seating, covered patios with BBQ facilities or similar park like
facilities shall be the same as projects having five units or more.
D. For one-family dwellings the minimum lot area may be reduced to four
thousand five hundred square feet per dwelling unit in accordance with Section 16.28.170 0.3.
E. Minimum lot area for multiple-family dwellings on a single lot with
adjacent property zoned for a use other than multi-family shall be the same as set forth in
paragraph "B" of this section.
SECTION 3
Section 17.14.026 B is hereby amended to read as follows:
17.14.026 Additional requirements.
B. Landscaping shall be subject to the requirements of chapter 17.61. In addition,
projects with four units or less a block wall and landscaping is required along arterial streets.
SECTION 4
Subsection E is hereby added to Section 17.14.026 to read as follows:
E. For multiple-family dwellings with four units or less, no more than two
adjacent buildings shall be perpendicular to the street. Street end unit entry and windows must
face street. Utility and AC units Shall not be visible from the street. Elevations for adjacent
units shall not be the same.
