I 4 1 - 9 8 A RESOLUTION ORDERING THE VACATION OF "F" STREET FROM THE NORTH RIGHT OF WAY LINE OF 14th STREET TO THE NORTH RIGHT OF WAY LINE OF THE B.N.S.F. RAILWAY IN THE CITY OF BAKERSFIELD. WHEREAS, on WEDNESDAY, SEPTEMBER 23, 1998, of the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, passed and adopted Resolution of Intention No. 1176 declaring its intention to order the vacation of "F" Street from the North right of way line of 14th Street to the North right of way line of the B.N.S.F. Railway in the City of Bakersfield; and WHEREAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA, pursuant to Sections 15061(b)(3) and 15301(c) of CEQA Guidelines in that there is no possibility that the street right of way vacation and proposed use could have a significant effect on the environment (minor alterations in land use limitations); and WHEREAS, at its meeting on August 20, 1998, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield General Plan; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on Wednesday, October 21, 1998, after notices were duly published and posted as required by law. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: Page I of 3 Pages The above recitals are true and correct and are incorporated herein. All of the 82.5 foot wide public street right of way for "F" Street bounded northerly by the westerly prolongation of the South line of Block 322 and bounded southerly by the easterly prolongation of the South line of Block 358 as said in street and blocks are shown on "Map of the City of Bakersfield" filed for record November 25, 1898, in Book I of Maps, Pages 13 and 14 in the Office of the Kern County Recorder. Also including that additional public street right of way dedicated at the southeast corner of said Block 358 per deed filed for record October 6, 1966, in Book 3986, Page 520, Official Records in the Office of the Kern County Recorder, is unnecessary for present or perspective use for public street purposes and is hereby vacation subject to the conditions enumerated herein. A nonexclusive easement shall be reserved for public utilities purposes in, under, over, and upon the entire above described public street right of way area and full access for utilities shall be maintained to the greatest extent possible. An easement shall be reserved by the City of Bakersfield for emergency fire protection access and service over the East 20 feet of the above described vacating area. The City Clerk shall certify to the passage of this Resolution and shall cause a certified copy hereof, attested by the Clerk under seal of the City, to be recorded in the Office of the County Recorder of the County of Kern, California.
