RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD AMENDING THE LOCAL IMPLEMENTATION
PROCEDURES OF THE CALIFORNIA ENVIRONMENTAL QUALITY
ACT (CEQA).
WHEREAS, the Public Resources Code of the State of California, Section
21082, requires that public agencies adopt objectives, criteria and procedures
for the evaluation of projects and the preparation of environmental documents in
compliance with the California Environmental Quality Act (CEQA); and
WHEREAS, the City initially adopted local CEQA Implementation
Procedures on April 16,1973 (Resolution 23-73) and subsequent amendments
have occurred to reflect changes in state law and local procedures; and
WHEREAS, the laws and regulations relating to CEQA have been followed
by the City and these amendments are found to be Categorically Exempt in
accordance with Sections 15307 and 15308 of the State CEQA Guidelines; and
WHEREAS, on May 6, 1998, City Council adopted amendments to the
City's CEQA Implementation Procedures which reflect changes in state law; and
WHEREAS, because state law requires the Central District Development
Agency ("Agency") to review, approve and certify environmental documents
relating to the adoption and amendment of redevelopment plans, the City's
CEQA Implementation Procedures need to reflect the Agency's role in the
process.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF BAKERSFIELD that Appendix A of the City's CEQA
Implementation Procedures attached hereto as Exhibit "A" is hereby adopted
and supercedes the Appendix A which was adopted on May 6, 1998.
