AMENDMENT NO. 2 TO RESOLUTION NO. 172-95
APPROVING THE DESTRUCTION OF CERTAIN OBSOLETE
CITY RECORDS, DOCUMENTS, INSTRUMENTS, BOOKS
AND PAPERS, PURSUANT TO SECTION 34090, ET SEQ.
OF THE GOVERNMENT CODE OF THE STATE OF
CALIFORNIA {CITY ATTORNEY'S OFFICE).
WHEREAS, on November 8, 1995, the City Council approved Resolution No. 172-
95 approving the destruction of certain obsolete City records, documents, instruments,
books and papers in the charge of the City Attorney; and
WHEREAS, on September 10, 1997, the City Council approved an amendment to
Resolution No. 172-95 approving the destruction of certain additional obsolete City
records, documents, instruments, books and papers in the charge of the City Attorney; and
WHEREAS, Section 34090, et seq of the California Government Code permits, with
certain exceptions, the head of a city department to destroy any City record, document,
instrument, book or paper under his/her charge, without making a copy thereof, after the
same is no longer required with the approval of the City Council by resolution and the
written consent of the City Attorney; and
WHEREAS, the City Attorney's Office created a retention schedule which meets
statutory. and City practice requirements to allow for further destruction of obsolete records.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
that pursuant to Section 34090, et seq. of the California Government Code, approval is
hereby granted for the destruction of items in accordance with the retention schedule set
forth in Exhibit "A" attached hereto.
