SUBJECT: UPDATE ON COMMUNITY PROSECUTION PROGRAM
Attached are the monthly reports for October, November and December, 2006. This
office processed an average of 50+ cases each month. The report separates the offenses
by ward for easy viewing.
Also attached is the statistical sheet showing all cases handled by the Community
Prosecution program from its inception (mid May) until the end of 2006. For the six and one-
half months the program has been in effect, the office processed 512 cases. The ward
breakdown is as follows:

Fifty percent of all cases, city wide, involved three types of crime: drunk in public
(22%); resisting arrest (14%); and petty theft (15%).
Pursuant to Council direction, two new crimes have been added to the quality of life
crimes handled by the community prosecutors (Penal Code section 12025 and 12031- gun
possession charges). As yet, no cases with those charges have been assigned to the office.

To date, one adult graffiti case was processed. The graffiti perpetrators typically are
juveniles. The defendant pled guilty and was sentenced to probation, a fine, community
service and ordered to pay restitution to the victim.
One community prosecution attorney is devoted to handling all of the criminal
prosecutions. The other two attorneys have-begun to assist the police department with
animal control hearings. Additionally, the attorneys attend code enforcement hearings and
help code enforcement officers with inspection and abatement warrants. Since the inception
of the community prosecution program, the attorneys have assisted in the preparation of 29
warrants.
Finally, this office has met and will continue to meet with the police department and
shortly will begin to resolve other quality of life issues by initiating drug and gang abatement
proceedings.

Council member Sullivan requested the Legislative and Litigation Committee
consider a possible smoke-free outdoor ordinance and staff to research other cities'
ordinances.
According to the City Attorney's Office, California's Health and Safety Code prohibits the
use and sale of tobacco products within the boundaries of a playground or tot lot. In
addition, this provision also provides for violation fines. Moreover, it allows cities to
pass and enforce ordinances with stricter provisions.
Attached are three memoranda from the City Attorney's Office, Park and Recreation
and Fire Departments. The City Attorney reviews the practices of various communities
regarding park signage. The other two departments speak to current practices.
Representatives from each department will be available at the meeting to review these
materials and respond to questions.

Smoking in City Parks

In 2001, the California legislature adopted Health and Safety Code section
104495 to help combat issues involving second-hand smoke. As written, that
section prohibited smoking a cigarette, cigar or other tobacco-related product
within the boundaries of any playground, or tot lot sandbox area. The law also
prohibited the disposing of the butts or other tobacco waste in that same area. A
violation of this section was deemed an infraction with a maximum fine of $100.
When Governor Davis signed the bill, he urged the author to propose new
legislation which would expand the area of the prohibition and raise the fine. In
2002, the legislature amended section 104495 to prohibit smoking or disposing of
butts within 25 feet of a playground or tot lot sandbox area. A violation remained
an infraction, but the fine was increased to $250. This section specifically allows
local governments to pass and enforce ordinances that are stricter.
In 2001, Bakersfield adopted Chapter 8.58 dealing with tobacco use
prevention. Although, there is no language in that section prohibiting smoking in
public places or, specifically, city parks, we can enforce Health and Safety Code
section 104495. A sampling of how other cities approach the situation is set
forth below.
California Cities
The city of Davis prohibits smoking in "public places". "Public places" is
defined as an enclosed area to which the public is invited. In addition to these
enclosed areas, Davis prohibits smoking in certain outdoor areas, namely,
"children's plan areas." Davis' ordinance requires "no smoking" signs to be
posted wherever smoking is regulated by the ordinance. A violation of the
ordinance is an infraction. The first violation results in a $50 fine, second within
one year is $200, third within a year is $500.
The city of Palo Alto prohibits smoking in all "service locations," defined as
"areas in dedicated parks or other publicly accessible areas that are within twenty
feet of bleachers, backstops, or play structures." , This ordinance also requires
posting of signs wherever smoking is prohibited.
Santa Monica's ordinance applies to the entire boundaries of public city
parks. The cities of Beverly Hills, Carson, San Fernando, Huntington Beach and
EI Monte have also extended the smoke-free policy to include entire city parks.
According to the Santa Monica Open Space Management Division,
enforcement of the measure has relied on voluntary compliance, a public
education outreach campaign, and reminders from park rangers. Santa Monica
has not increased enforcement, does not issue tickets for violations (except in
the rare case of a refusal to comply), and has not measured the impacts on
smoking or littering in the parks since the ordinance passed last year. Also,
Santa Monica's ordinance does not require signage, but the city does post signs
in areas where smoking is restricted.
Calabasas and Dublin have recently taken action to further restrict the
areas in which smoking is permitted. Calabasas banned smoking in all indoor
and outdoor public places, except for a handful of scattered, designated outdoor
smoking areas in town and private residences. The ordinance also requires signs
to be posted in areas where smoking is prohibited. A violation is a misdemeanor,
which can be reduced to an infraction by a prosecutor. The ordinance also
declares that second-hand smoke constitutes a public nuisance, so private
citizens may take action. This is believed to be the strictest ban in the United
States.
Dublin recently amended its ordinance to add a section that declares
second-hand smoke a nuisance, becoming only the second city in the state
behind Calabasas to do so. The ordinance does not provide for enforcement, but
merely enables private citizens to take action in court without having to prove to
the judge that the smoke constitutes a .nuisance. Judgments can include
injunctions and monetary damages or both. The maximum judgment of damages
in such a case is $7,500.
Conclusion
There is no requirement in Health and Safety Code section 104495 that
requires the posting of signs setting forth the smoking prohibition. It would
appear that the cities which enacted stricter ordinances posted signs to be user
friendly and alert tourists and other visitors of the prohibition.

The State of California Health and Safety Code, Section 104495, item b states:
"No person shall smoke a cigarette, cigar or other tobacco related products within
25 feet of any playground or tot lot sandbox area."
Item c: "No person shall dispose of cigarette butts, cigar busts, or any other
tobacco-related waste within 25 feet of a playground or a tot lot sandbox area."
These two items from the Health and Safety Code were brought to my attention
last fall when a parent of a young child observed people smoking next to where
his child was playing on the playground. He researched the laws, and was able
to find the above codes which apply to public playgrounds. He then requested
that we put up signs in each one of playgrounds, to inform people of this law.
Several problems arise with this request, and involves the City Attorney's office,
Fire Department and the Police Department, in addition to the Recreation and
Parks staff. With nearly fifty playgrounds in city parks, where exactly does a sign
go? If we erect one sign in each park, a person could possibly enter a park and
playground from various points and never see the sign. Therefore, would we
need more than one sign at each playground?
With the written law being specific on 25 feet away, would we need to draw a
radius around each playground to indica#e the no smoking area?
Lastly, how do we enforce such a law? Typically, when staff has approached
smokers to comply with the current law, especially around children, they comply.
If the police are called to the scene due to a smoker next to a playground that
won't leave the premises or put out the cigarette, what would be the priority on
such a call?
As a viable solution to these questions, the Recreation and Parks Department
has printed a statement in the front of the program brochure stating the code and
the possible fine of $250.00 for first occurrence. At this time, we believe that
educating the public on the law is the frst step to compliance. The brochure is
mailed to over 100,000 households three times a year, and people who are park
users and participants do pay attention to the contents of the brochure. In
addition, we are in the process of revising the park reservation forms which will
also state the relevant Health and Safety Code.
The Department of Recreation and Parks is very interested in creating and
maintaining outdoor play areas that are welcoming, safe and enjoyable for all.

This °tot-law° is almost a nuisance law and should be addressed accordingly. If we get several
complaints about someone smoking in a park, one of my staff would drive by. The challenge is,
due to the priority of our calls, we cannot respond in a timely manner. In the last twelve years
we have never received a complaint of someone smoking in or around a park.
The Fire Department is responsible for regulating smoking complaints in businesses,
restaurants, and bars.

Councilmember Scrivner requested the Legislative and Litigation Committee consider a
mod cation to the fireworks ordinance to allow individuals who are not licensed
pyrotechnicians to be able to use fireworks, on days other. than July 4"' and New Years Eve,
for special events such as birthdays and other celebrations.
I strongly disagree with this proposed change on many levels. As you know, I was part of the
team that was tasked with the challenge of developing our current Ordinance which was safety
driven. Making this proposed change #o our current Ordinance would undermine all the work
that went into its original development. The following are a number of reasons why the proposed
change should not be implemented:
• Fireworks were originally produced to celebrate our Nation's Independence Day. Over
time, citizens were discharging them on any day of the year creating hazardous
conditions for the surrounding citizens and the area. This was the impetus for
developing our current Ordinance.
• Recent statistics show 84% of the number of fireworks' injuries reported to emergency
departments involve fireworks that are. deemed safe and sane.
• 60% of those injured were younger than 1~ years of age.
• Our current fireworks' Orciinance involved the input of many constituencies, such as the
Bakersfield Fire Department, Kem County Fire Department, City Council, fireworks
vendors, and non-profit organizations.
• We do not have the resources to police these individual events.
• Task Forces that were implemented last year to curb unauthorized Fireworks use, such
as modifying safe and sane' fireworks, using iAegal fireworks, and discharging fireworks
outside of the prescribed time frame were very successful and we intend to use them
again this year.
A possible amendment to our Ordinance would create a large loophole and would render its
effectiveness null and void..

SUBJECT: ONE DAY USE PERMITS FOR FIREWORKS
In response to Councilmember Scrivner's referral, staff has prepared a
draft ordinance regarding one day permits for the use of "safe and sane"
fireworks in the City.
The proposed language would authorize one day permits for the personal
use of fireworks, as the code presently allows only pyrotechnicians use year-
round. The language can be added to Chapter 8.44 of .our Municipal Code,
which addresses the regulation of fireworks in general. The most appropriate
section for this language would be 8.44.040 "Regulations" as part of sub-section
"S," as this part addresses the regulation of the use of fireworks.

AN ORDINANCE OF THE COUNCIL OF THE CITY
OF BAKERSFIELD AMENDING SECTION 8.44.040
OF THE BAKERSFIELD MUNICIPAL CODE
RELATING TO FIREWORKS.
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Section 8.44.040 of the Bakersfield Municipal Code is hereby amended to read
as follows:
8.44.040 Regulations.
A. Those fireworks which are classified as "dangerous" fireworks under
Section 12505 of the California Health and Safety Code are prohibited, except that such
fireworks as are defined and classified as "safe and sane fireworks" in Section 12529 of
the California Health and Safety Code may be displayed, sold and used pursuant to the
provisions of this chapter and not otherwise. Notwithstanding anything to the contrary,
"Piccalo Pete" type and "Ground Flower" type fireworks shall not be used, displayed, or
sold separately or in combination with otherwise allowed fireworks.
B. No permit holder shall shout, make any outcry, blow a horn, ring a bell or
use any other sound device including any loudspeaker, radio or amplifying system
where sound of sufficient volume is emitted or produced there from capable of being
plainly heard upon the streets, alleys, parks or other public places.
C. Any permit issued pursuant to this chapter shall be nontransferable, and
shall be valid only as to the applicant and location provided on the application for such
permit, or as set forth in Section 8.44.030(F) or 8.44.035(F). Locational preference shall
be given for the consecutive use of a particular location by the applicant as established
by the previous year's approved plot plan assuming all other provisions of this
ordinance are complied with. If two or more applications for new stand locations are
within the minimum four hundred foot distance requirement of each other, preference
shall be determined by a drawing conducted by the city manager or his/her designee.
D. Except as expressly permitted by and in accordance with the provisions of
Chapter 12.44 of this code, the sale, offer to sell, advertising or display of merchandise
on any street or sidewalk in the city or roof of the fireworks stand is prohibited.

E. All retail sales of safe and sane fireworks shall be permitted only from a
temporary fireworks stand and the sale from any other building or structure is prohibited.
The sale of any other items or commodities (e.g., consumables) in conjunction with the
sale of safe and sane fireworks is strictly prohibited.
F. No fireworks stand shall be located within one hundred feet of any
aboveground or underground gasoline storage or gasoline pump or any garage or within
thirty feet of any other building, or within four hundred feet of any other fireworks stand,
when measured closest point to closest point.
G. Fireworks stands need not comply with the provisions of the building code
of the city except that the building official shall have authority to require that stands be
constructed in a manner which will reasonably ensure the safety of attendants and
patrons. Fireworks stands may utilize shading devices such as canopies or awnings for
the convenience of patrons subject to the following limitations:
1. The location and dimensions must be shown on the approved plot plan;
2. Cannot cover or impede any public rights-of-way;
3. Must be freestanding (not anchored or tied to any public property such as
light or electrical poles);
4. Must not cover the booth or any portion thereof;
5. Must meet all Uniform Fire Code specifications as adopted by the city,
including flame retardancy and setback requirements;
6. Must provide shade from the top only (no sides). Banners, signs or other
items on or hanging from the awning or canopy are prohibited;
7. May not reduce the number of parking spaces required by the traffic
authority; and
8. Display or sale of fireworks from the awning or canopy area is prohibited.
H. Fireworks stands shall be located only in a C-1 zoning district or a zoning
district less restrictive than C-1, unless located upon property owned and occupied by a
church and/or school, which church or school is either a legal or legal nonconforming
use of such .property.
I. All temporary stands for the display and sale of fireworks shall obtain an
electrical permit from the city building department, if electrical current is utilized or
necessary.
J. If a toilet is not immediately available during all open or sale hours of the
fireworks stand, then an approved chemical one must be provided.

K. Each fireworks stand must have at least two exits. Each fireworks stand in
excess of forty feet (12,192 mm) in length must have at least three exits. Exits shall
have a minimum width of thirty inches (76 mm). An aisle with a minimum width of thirty
inches (76 mm) shall lead to each exit. Exit doors shall be operable from the inside
without the use of a key or any special knowledge or effort.
L. Each stand shall be provided with not less than two 2A 10 BC-type fire
extinguishers, underwriter approved, in good working order and easily accessible for
use in case of fire.
M. No person shall light, or cause or permit to be lighted, any fireworks or any
other article or material within any such stand, or within fifty feet thereof.
N. No smoking shall be allowed in any stand, nor within fifty feet thereof. "No
smoking" signs shall be prominently displayed.
O. All weeds and combustible material shall be cleared from the location of
the stand, including a distance of at least twenty feet surrounding the stand.
P. There shall be at least one adult in attendance during the open or sale hours
of the fireworks stand. No minor under the age of eighteen shall be permitted in a stand.
Q. All permits must be posted in a conspicuous place.
R. "Safe and sane" fireworks may be sold only as follows:
1. On July 1 between the hours of twelve noon and eleven p.m.
2. On July 2 between the hours of six a.m. and eleven p.m.
3. On July 3 between the hours of six a.m. and eleven p.m.
4. On July 4 between the hours of six a.m. and 12:01 a.m. of the next day.
S. Except for ne day Hermit holders (see below at #6) and licensed
pyrotechnicians, "safe and sane" fireworks may be used only on the following dates and
times:
day.
1. On July 1 between the hours of twelve noon and 12:01 a.m. of the next
2. On July 2 between the hours of nine a.m. and 12:01 a.m. of the next day.
3. On July 3 between the hours of nine a.m. and 12:01 a.m. of the next day.
4. On July 4 between the hours of nine a.m. and twelve-thirty a.m. of the next
day.

5. On December 31 between the hours of twelve noon and twelve-thirty a.m.
of the next day.
6 Notwithstanding the above the city manager or his designee may

compliance with mandatory safety precautions as prescribed by the city manager
or his designee.
T. Permittee shall strictly comply with all provisions of the State Fireworks
Law (Sections 12500 et seq. of the Health and Safety Code).
U. The fireworks stand shall be removed from the temporary location by
twelve noon on July 15, and atl accompanying litter shall be cleared from said location
on or before said time.
V. Night watchman accommodations shall not be closer than twenty-five feet
from the fireworks stand.
W. No fireworks shall be placed in any fireworks stand until a permit for such
stand has been issued by the city.
X. Any person who receives a notice to correct any violation of these
regulations or any other condition of the permit, and who fails to correct such violation
within the time prescribed in the notice, may be assessed a fee not exceeding the city's
cost of reinspection in accordance with Section 3.70.040 of this code.
Y. Each fireworks stand shall prominently display and provide safety
educational materials that have been approved by the city's fire chief. A copy of the
required materials shall be provided by the Bakersfield fire department. Required
materials shall be paid for by the applicant and distributed with each fireworks sale.
Z. All enforcement of the provisions of this chapter may be conducted
pursuant to Chapter 15.64.
SECTION 2.
This Ordinance shall be posted in accordance with the provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and after
the date of its passage.

Enforcement Issues

The proposed modification of the existing fireworks ordinance to allow individuals
who are not licensed pyrotechnicians to be able to use fireworks, on days other than
July 4th and New Years Eve for special events such as birthday parties and other
celebrations raises a number of concerns from a risk management perspective and
potential liability to the City. Allowing such use would be very difficult to monitor
and enforce for police and fire officials and there is potential for injury and fire
damage related to such increased use. The issuing of a permit by the City to allow
such periodic use without a pyrotechnic license as currently required by the
ordinance would create increased liability for the City. The Fire Department
currently reviews permits for pyrotechnic shows, verifies licenses, requires
insurance, performs inspections to make sure the devices are properly installed,
inventory accurate and depending on the size of the show is in attendance at such
displays to insure proper safety precautions including proper seating arrangements,
fallout areas and appropriate spectator distances are adhered to.
Given the recent history of fireworks related fires and serious injuries in our City it
would not be prudent to further extend the use of fireworks in the community. The
use of fireworks by those without specific training and expertise in the safe use of
such devices and adequate levels of insurance to limit exposure to claims by those
who may experience losses due to such fireworks use would contribute to the city's
liability. It would be very difficult to monitor the proper use of such devices and to
make sure modifications were not made to them which could cause fires, property
damage or injuries to innocent third parties.
Additionally, allowing fireworks permits for special events may result in increased
citizen complaints and confusion regarding when the legal use of fireworks is
allowed. The average citizen will not know if their neighbor using fireworks has a
permit or not and may object to the shooting of fireworks or complain that they are
using them outside the time frames allowed by City codes. They will likely call the
City with complaints which will have to be responded to. Some who see fireworks

being used at times other than the proscribed periods in the current code may get
the impression there is no regulation or enforcement and they may decide they can
use fireworks whenever they please, making public education about the proper
dates of use and enforcement requirements more difficult and confusing for the
public.
Further, considerable effort was made to encourage uniformity between City and
County regulation and enforcement of fireworks in the community. Changes by the
City alone would undermine cooperative efforts to provide a seamless enforcement
strategy and educational efforts to the public throughout the metropolitan Bakersfield
area.
Based on the potential liability, staffing cost and enforcement impacts staff does not
recommend the proposed change to the ordinance.

Thank you for returning my call regarding the background and impetus for the fireworks item on today's
Leg amp; Lit Committee Meeting agenda.lt's my understanding that Phantom Fireworks' representative
has requested an amendment to the City's ordinance to allow "one day use or discharge of
state-approved fireworks outside the 4th of July sale/use period,subject to a permit issued by the City Fire
Department."
You explained that Phantom said they needed this because they had suffered the loss of their employee
who was a licensed pyrotechnician and they needed to be able to discharge fireworks at the safety
orientations for their nonprofit groups. These orientations are held by both Phanton Fireworks and TNT
Fireworks/American Promotional Eventsweeks in advance of the authorized sales and use period. You
also explained that Phantom wanted it so that individuals could apply to discharge state-approved
fireworks on special occasions.
I informed you that my client (TNT Fireworks) led the way 30 plus years agoin California by every
yearstaging these safety orientations for all the nonprofit group retailers throughout California.They are
held in every community inwhich our client distributes state-approved fireworks. In almost all instances,
representatives of the local fire departmentare requested to attend and address the nonproit groups
about any issues or concerns they have as well as how booth inspections will take place, etc. My client
requests and gains the verbal and, in many instances,written approval of the fire department in the
juridiction where the orientation is taking place to be permitted to discharge all new as well as some long
time favoritefireworks items for the nonprofi groups to see. No jurisdictionthat Iknow of requires that a
licensed pyotechnician be present.
Prior to sending you this email, I checked with Chief Fraze regarding this. He left me a voice mail that he
had checked with the City Attorney and she thought we would need a licensed pyrotechncian to do this
as the ordinance now reads. This is so unnecessary and overkill, particularly if members of the City Fire
Department are there! This discharge at the orientationshas always been handled in this informal way.
TNT Fireworks, and its predecessor in interest, and the City of Bakersfield have been doing it this way for
over 30 years without incident. There is no need to change the current approach. A pyrotechnician's

license is required for someone who discharges public display type (areial), Class B Fireworks.....We are
talking about state-aproved fireworks here..
As to the second reason for Phantom's request, this does not make sense either. In essence we would
be encouragng a consumer to store state-approved fireworks in their home throughout the year to then
have them availableto discharge on a special occasion. Neither my client nor Phantom could legally sell
them fireworks outside the time period specified in state law.
