ORDINANCE ADDING SECTION 8.16.065 OF THE
BAKERSFIELD MUNICIPAL CODE RELATING TO USE
OF AMPLIFIED SOUND BY ICE CREAM VENDORS
BE IT ORDAINED by the Council of the City of Bakersfield as follows:
SECTION 1.
Section 8.16.065 of the Bakersfield Municipal Code is hereby added to read as
follows:
8.16.065 Selling -Amplified sound requirements.
A. It is unlawful for any person, firm or corporation to use amplified music or speech
emitted via sound equipment from any wagon, pushcart or other vehicle used to vend or
peddle pop, soda water or other soft drink, ice cream, ices or other frozen dainties
outside the hours of:
1. 9:00 a.m. to 5:00 p.m. on Sundays; and
2. 8:00 a.m. to 8:30 p.m. from May 1st through September, Monday through
Saturday; and
3. 9:00 a.m. to 5:00 p.m. from October 1st through April on Mondays through
Saturdays.
B. The volume of sound from any vehicle referenced in section A shall be controlled
so that it will not be audible for a distance in excess of one hundred fifty feet from the
vehicle upon which such sound equipment is located, and so that such volume is not
unreasonably loud, raucous, jarring, disturbing or a nuisance.
SECTION 2.
This Ordinance shall be posted in accordance with the provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and after
the date of its passage.
