Pursuant to the provisions of Chapter 12.20 of the Bakersfield Municipal Code, the undersigned applies for a permit
to place, erect, use and maintain an encroachment on public property o~ right of way as therein defined.

Applicant agrees that if this application is granted, applicant will idernnify, defend and hold harmless City, its
officers, agents, and employees against any and all liability, claims, actions, causes of action or demands, whatsoever
against them, or any of them, before administrative, quasi-judicial or judicial tribunals of any kind whatsoever,
arising out of, connected with or caused by applicant's placement, erection, use (by applicant or any other person or
entity) or maintenance of said encroachment. The applicant further agrees to mantain the aforesaid encroachment during
the life of the said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this application is made, if granted, or upon
revocation thereof by the City Engineer, applicant will at his own cost and expense remove the same from the public
property or right of way where the same is located, and restore said public property or right of way to the condition
as nearly as that in which it was before the placing, erection, maintenance or existence of said encroachment.
Applicant further agrees to obtain and keep all liability insurance required by the City Engineer in full force and
effect for however long the encroachment remains. Applicant shall furnish the City Risk Manager with a certificate
of insuance evidencing sufficient coverage for bodily injury or property damage liability of both and required
endorsements evidencing the insurance required.

Applicant agrees that if this application is granted, applicant shall indemnify, defend and hold hannless City, its
officers, agents, and employees against any and all liability, claims, actions, causes of action or demands,
whatsoever against them, or any of them, before administrative, quasi-judical,or judicial tribunals of any kind
whatsoever, arising out of, connected with, or caused by applicant's placement, erection, use (by applicant or any
other person or entity) or maintenance of said encroachment. The applicant further agrees to maintain the aforesaid
encroachment during the life of said encroachment or until such time that this penn it is revoked.

General:
1. Furnish and install all labor and materials required to construct conduit and
vault system is shown on the attached drawing. This system is an extension
of the conduit system being installed to the DA Administration and Crime Lab
Building by the COUAty of Kern. County of Kern specifications are attached
for reference as to quality of materials and performance of work.
2. The Kern County Superintendent of Schools reserves the right to reject any
and all quotes, to accept or reject anyone or more items of a quote, or to
waive any irregularities or informalities in the quotes.
3. In case of default by the vendor, the County Superintendent of Schools may
procure the articles or services from other sources and may deduct from the
unpaid balance due the vendor or may collect against the bond or surety for
excess costs so paid, and the prices paid by the County Superintendent of
Schools shall be considered the prevailing market prices at the time such
purchase is made.

4. Labor and Materials proposals submitted to this office shall be subject to the
provisions of Section 1720, California Labor Code and Section 3700,
California Labor Code, which requires workmen's compensation insurance to
be provided by the contractor.
5. This is prevailing wage job. Prevailing wage schedules are on file in the Kern
County Superintendent of Schools Office and are available for review upo':1
request.
6. Contractor will pay for and secure the necessary permits from the City of
Bakersfield.
7. Successful contractors shall furnish to the Owner a copy of valid Worker's
Compensation and insurance certificates.
8. All contractors shall make themselves knowledgeable of existing site
conditions. Not visiting is not an excuse for extra costs.
9. Construction shall meet all requirements of the City of Bakersfield.
10. Periodic payments shall be made on a form acceptable to the OwneL 10%
retention of contract cost may be withheld for 35 days after the filing of the
Notice of Completion.
11. General Contractor shall be responsible for all repair or replacement of any
damage caused by his operation.

2. Verify all points of connections (POE) to existing conduit and vaults.

1. Do not accept material unless it is covered with a tarpaulin until unloaded, and unless
the material has a temperature of not less than 285 degrees F.
2. Do not commence placement of asphaltic concrete materials when the atmospheric
temperature is below 50 degrees F., nor during fog, rain, or other unsuitable
conditions.
D. Spreading:
1. Spreading material in a manner which requires the least handling.
2. Asphalt concrete shall be spread with a self propelled spreader ready for compactio~
and further shaping.

After the material has been spread to the proper depth, roll until the surface is hard,
smooth, unyielding, and true to the thickness and elevations shown on the Drawings~

3.3 APPLICATION OF SEAL COAT
A. Protect all non-asphalt surfaces from over spray.
B. Prepare the surfaces, mix the seal coat material, and apply in accordance with the Standard
Specifications and as approved by the ArchitectlEngineer.
C. Apply one coat of sealer.
D. Achieve a finished surface seal which, when dry and thoroughly set, is smooth, tough,
resilient, of uniform black color, and free from coarse textured areas, lap marks, ridges,
and other surface irregularities.
3.4 PROTECTION
A. Protect the asphaltic concrete paved areas from traffic until the sealer is set and cured and
does not pick up under foot or wheeled traffic.

SLURRY CEMENT BACKFILL
A. General: Slurry cement backfill shall consist of a fluid, workable mixture of aggregate,
cement and water.
B. Cement: Portland cement conforming to the provision in Section 90-2.01, "Portland
Cement", except that testing will not be required.
C. Aggregates: Commercial quality concrete sand.
D. Water: Free from oil, salts and other impurities which would have an adverse effect on
the quality of the backfill material.
E. The aggregate, cement and water shall be proportioned either by weight or by volume.
Not less than 188 pounds of cement shall be used for each cubic yard of material

produced. The water content shall be sufficient to produce a fluid, workable mix that
will flow and can be pumped without segregation of the aggregate while being placed.
F. Materials for slurry cement backfill shall be thoroughly machine mixed in a pugmill,
rotary drum, or other approved mixer. Mixing shall continue until the cement and water
are thoroughly dispersed throughout the material. Slurry cement backfill shall be placed
in the work within one hour after mixing.
PART 3 - EXECUTION
3.1 PLACING SLURRY CEMENT BACKFILL
A. Notify ArchitectlEngineer minimum 24 hours prior to commencement of operations.

B. Slurry cement backf1l1 shall be placed only for that portion of the backfill below the
original ground. .
C. Where necessary, earth plugs shall be compacted at each end of the pipe prior to placing
backfill in a manner that will completely contain the slurry in the pipe trench.
D. Slurry cement backfill shall be placed in a uniform manner that will prevent voids in, or
segregation of, the backflll, and will not float or shift the conduit. Foreign material
which falls into the trench prior to or during placing of the slurry cement backfill shaIi
be immediately removed. .

until four (4) hours after the slurry cement backf1l1 has been placed, except that when

is located along various locations of "L" Street between TruxtunAve. and 2151 Street.
The applicant has provided proof of appropriate insurance coverage to Risk Management.
Based on their review, staff recommends approval of the permit. .
