APPLICATION FOR ENCROACHMENT PERMIT

Pursuant to the provisions of the Ordinance No.3140 New Series of the City of
Bakersfield, the undersigned applies for a permit to place, erect and/or
maintain an encroachment on public property or right of way as therein defined

6 FT FENCE ALONG BACK OF SIDEWALK.
The location of proposed encroachment is :
FROM THE EXISTING FENCE CORNER, THE FENCE WILL
EXTEND AT 45 DEGREES TO THE NORTHEAST UNTIL IT
REACHES THE SIDEWALK. IT WILL THEN EXTEND
NORTHERLY ALONG THE BACK OF THE SIDEWALK.
Applicant agrees that if this application is granted, applicant will idemnify
defend and hold harmless the City of Bakersfield, its agents, officers, and
employees against and from all damages, judgement, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from or obtainable against the City of Bakersfield or such officer
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the
life of said encroachment or until such time that this permit is revoked
Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon revocation thereof by the City
engineer, applicant will at his own cost and expense remove the same from
the public property or right of way where the same is located, and restore
said public property or right of way to the condition as nearly may be in
in which. encroachment before the placing, erection, maintenance o~ existence
of said encroachment.

SUBJECT: Encroachment Permit for Fence at 9300 Windcreek Court
The applicants wish to relocate an existing fence along their Windsong Street frontage
to the back of sidewalk. The fence is currently approximately 4' from the back of
sidewalk. Review of the property in question shows that the current fence is located right
at the edge of the 60'x 60' clear sight area required by City Standards for uncontrolled
intersection. We recommend approval of the encroachment permit application if either
one of two conditions is met:
1. The south end of the fence will angle back at 45. from the current fence corner to the
back of sidewalk with the fence then proceeding north along the back of sidewalk.
2. The end of the fence is moved north 4', extending to meet the relocated fence at
back of sidewalk.
Either of these two options will keep the fence clear of the City Standard 60'x 60' clear
sight line area.

RELOCATION OF A 6' HIGH WOOD SIDEYARD FENCE TO BEHIND SIDEWALK

Engineering and Traffic staff have reviewed the attached encroachment permit to allow the relocation of a
6' high wood fence from the property line to directly behind the back of the sidewalk along the sideyard (along
Windsong Street) of the above-referenced residential lot. Due to sight line considerations, the fence is not
able to be extended directly out to the sidewalk but must be angled back at 45 degrees from the existing
corner fence post to the sidewalk. The fence would then extend along the back of the sidewalk to the north
property line. Across the street from the fence (across Windsong Street) is an area that is farmed. The
applicant states that the residence directly across Windcreek Court from their house is vacant. Therefore, no
adjacent residents have signed a petition in support of the fence installation. Staff recommends approval of
the permit.
