Dear Sir,
On October 16th, 1995 it was brought to oUr attention that we "Should apply for an
. encroachment permit to build a fence in the city right-of-way," and that we should not grout
, '
a portion of our newly constructed 2 1/2 ft, high cement block wall "until a permit has been
obtained." We subsequently complied with that directive----dutifully paying the $125.00 fee
only to be told that we now must remove a 5 ft. section of wall that abuts our front curb.
We have taken great care to construct a properly built, safe, and. aesthetically pleasing
structure that maintains continuity with the existing architecture in our area. There are no
sidewalks in our general vacinity. There are however, scores of permanent fixtures existing

in the city right-of-way, including masQruuy structures; brick walls, woodenfence,s, mailboxes
private light fixtures, concrete steps, walkways, vario~s designs of unconventional drive
approaches, utility poles~ irrigation systems, fire hydrants, and all sizes 'and varieties of
trees~ vines and hedges.
The effect of the wall at 1221 Shattuck Ave. on the immediate, community is not

one of negative consequences but rather, we feel, a stylish addition that enhances our '
~perty and affords us optimal enjoyment in our home as well as civic pride in our lovely
neighborhood.
The design of the wall in no way deviates from the presently existing environment.
The low profile, presents no sight view hazard and conforms nicely with other existing

structures~-"-ofwhich there are many in the vacinity; further, it interferes with no right
enjoyed by the general public.
Please note that while we certainly hold the coneept of the public welfare ill high ,
regard, it will be no better served by removal of five feet of this structure; a structure
that neither imperils public safety, nor contributes'to the making of a slum or blighted ,

area. Our concern and desire is that our community should be beautiful and well--balanced
as well as safe/healthy and thoughtfully regulated, We, therefore, request approval for
the "non-conforn:llng" use ofthe 5 ft. easement in question fof completion of our/wall.

INSTALLATION OF A CONCRETE BLOCK WALL AT BACK OF SIDEWALK

Engineering and Traffic staff have reviewed the attached encroachment permit to allow the installation of a
concrete block wall, that varies in height but does not exceed 4' in the front yard setback area, along the..eftSt-
side of the lot at the above address. This is an existing wall that was caught by the Building Department as
being constructed without the required permitting. The existing wall extends to the back of the curb, as there
is no sidewalk in the area. But staff believes that adequate distance (5') from the face of the curb should be
maintained to allow pedestrian traffic to walk outside of the roadway, and this will require removal of a
portion of the wall. Adjacent residents have signed a petition in support of the wall installation. Staff
recommends approval of the permit with the conditions as stated on the permit.

Engineering Division ami Traffic Division staff have reviewed the attached encroachment permit
application to allow the installation of a barrel vault awning, which will be a minimum of 8 feet above the
sidewalk and encroach 4 feet into the right of way (these dimensions meet the requirements of Section 4506 of
the Uniform Building Code). Staff recommends approval of the application and issuance of the permit.

ma~nta~n an encroachment on public property or right of way as therein defined

SOUTH, WEST SIDES OF BLDG.
Applicant agrees that if this application is granted, applicant will idemnify
defend and hold harmless the City of Bakersfield, its agents, officers, and
employees against and from all damages, judgement, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from or obtainable against the City of Bakersfield or such officer
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the
life of said encroachment or until such time that this permit is revoked
Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon revocation thereof by the City
engineer, applicant will at his own cost and expense remove the same from
the public property or right of way where the same is located, and restore
said public property or right of way to the condition as nearly may be in
in which encroachment before the placing, erection, maintenance or existence
of said encroachment.
