INsrAUATION OF A 4' HIGH WROUGHT IRON FENCE BEHIND SIDEWALK

Engineering and Traffic staff have reviewed the attached encroachment permit to allow the installation of a 4'
high wrought iron fence directly behind the back of the sidewalk along 18th Street. The purpose of the fence
is to try and dissuade homeless from using the porch of this building for a sleeping area (They evidently have
had a problem with this as the building is located directly across the street from the bus station.). The
protruding ends of the wrought iron pieces are required to be rounded. Staff recommends approval of the
permit.

APPLICATION FOR ENCROACHMENT PERMIT
TO THE CITY ENGINEER OF THE CITY OF BAKERSFIELD CALIFORNIA:
Pursuant to the provisions of the Ordinance No.3140 New Series of the City of
Bakersfield, the undersigned applies for a permit to place, erect and/or
maintain an encroachment on public property or right of way as therein defined

The nature or description of this encroachment application is as follows:
WROUGHT IRON FENCE ALONG THE EDGE OF EXISTING
BRICK SIDEWALK 4 FT HIGH, ENCROACHING 3 FT INTO
CITY RIGHT - OF-WAY. TWO ACCESS GATES TO BE
INSTALLED, W/GATES SWINGING INWARD. SEE ATTACHED
DRAWINGS. ALL PROTRUDING ENDS TO BE ROUNDED.
The location of proposed encroachment is :
ALONG FRONT OF PROPERTY AT 18TH ST.
Applicant agrees that if this application is granted, applicant will idemnify
defend and hold harmless the City of Bakersfield, its agents, officers, and
employees against and from all damages, judgement, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from or obtainable against the City of Bakersfield or such officer
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the
life of said encroachment or until such time that this permit is revoked
Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon revocation thereof by the City
engineer, applicant will at his own cost and expense remove the same from
the public property or right of way where the same is located, and restore
said public property or right of way to the condition as nearly may be in
in which encroachment before the placing, erection, maintenance or existence
of said encroachment.
