Pursuant to the provisions of Ordinance No. 3140 New Series of the City of
Bakersfield, the undersigned applies for a permit to place, erect and/or maintain
an encroachment on public property or right of way as therein defined.

Applicant agrees that if this application is granted, applicant will indemnify,
defend and hold harmless the City of Bakersfield, its agents, officers and
employees against and from all damages, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon the revocation thereof by the City
,Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way to the condition as nearly may be in which it
before the placing, erection, maintenance or existence of said encroachment.

BOARD OF ZONING ADJUSTMENT
OF THE CITY OF BAKERSFIELD
ZONING RESOLUTION AND CERTIFICATE OF
FINDINGS OF FACT IN REGARD TO THE AP-
PLICATION OF R. HAMILTON AGENT FOR
RONALD STEINMAN REQUESTING A MODIFI-
CATION OF THE LAND USE ZONING ORDINANCE
OF THE CITY OF BAKERSFIELD AFFECTING
THAT CERTAIN PROPERTY AS HEREINAFTER
DESCRIBED AND ZONED AS AN R-l (ONE
FAMILY DWELLING) ZONE TO PERMIT THE
REDUCTION OF THE REQUIRED TEN-FOOT
SIDE STREET YARD SETBACK TO SEVEN
FEET ALONG WITH ELIMINATING THE RE-
QUIRED OFF-STREET PARKING ON THAT
CERTAIN PROPERTY COMMONLY KNOWN AS
2120 "B" STREET.
WHEREAS, R. HAMILTON, AGENT FOR RONALD STEINHAN filed a
written application with the Board of Zoning Adjustment requesting
a modification to permit the use of those certain premises as set
forth in said application for the purpose of permitting the re-

feet along with eliminating the required off-street parking, on
the following described property:
The North 72 feet of Lots 6, 7, S, 9 and 10,
Block 455A of the Northern Divisioi, Ciiy of
Bakersfield, County of Kern, State of Cali-
fornia, as per map recorded April 26, 1889
in Book 1 at Page 21, Office of the Kern County
R\Corder.
and
WHEREAS, the Board of Zoning Adjustment did meet at 3 p.m.,
September 11, 1979, in the Council Chamber of City Hall, Bakersfield,
California, and did consider said application pursuant to Title
Seventeen of the Bakersfield Municipal Code;
and
WHEREAS, at said hearing held September 11, 1979, the applica-

1) The applicant did show that the grapt-
ing of such Modification would not be
materially detrimental to the public
welfare, nor injurious to the property
or improvements in the zone or vicinity
in which the property is iocated.

The applicant did show that such Modifi-
cation is necessary to secure appropriate
improvement on the lot.
The above findings were based on the following facts:

The applicant is requesting the waiving
of the sidewalk requirement as per con-
dition on said Modification which was
heard by the Board on August 28, 1979.
The reason for this request is to S':lVC
three large trees which are located in
the proposed sidewalk alignment.

The Public Works Department concurred
that these trees should be saved as they
enhance this street, and recommends the
'deletion of the sidewalk requirement on
Modification 3323.

No one appeared in opposition to this
proposed Modification.

A preliminary environmental assessment
was made on the application and it was
determined to be Categorically Exempt
under Article III, Class 5(c) of Council
Resolution 39-78.
WHEREAS, at said meeting lleld September IJ, 1979, it was
resolved by the Board of Zoning Adjustment to approve the applica-
tion for a Modification modifying the provisions of Title Seven-
teen of the Bakersfield Municipal Code as set forth and designated
on the Zoning Map incorporated within and made a part of said Code
to the extent of the following and no further:

tation of any of the provisions of the
Municipal Code when practical diffi-
culties, unnecessary hardships or re-
sults inconsistent with the general
purposes of this Code occur by reason
of such strict interpretation.
