Applicant ag~ees that if this application is granted, applicant will indemnify,
defend and hold harmless the City of Bakersfield, its agents, officers and
employees agai~t and from all dam~ges, judgments, claims, demands, ex~enses,

costs and expenditures, and against all loss or liability which the City of
Bakersfield or su~h officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of "the said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way to the condition as nearly may be in which it
before the placing, erection, maintenance or existence of said encroachment.

NOTICE OF DECISION
BOARD OF ZONING ADJUSTMENT
OF THE CITY OF BAKERSFIELD

At a regular meeting held August 28, 1990, the Board of Zoning
Adjustment of the City of Bakersfield considered the application of
ART DANSBY requesting Modification of an R-l (One Family Dwelling) Zone to
permit the reduction in the front yard setback (25 feet to 19 feet), street
side yard setback (10 feet to 5 feet), rear yard setback (22 feet to 5
feet) and distance between buildings requirement (10 feet to 5 feet) to
allow construction of additional floor space at the rea~ of a res~dence and
, a covered porch at the front of a residence on that certain property com-
monly known as 2701 Pine Street.
At the conclusion of the hearing on the application, it was moved by
Chairman Bidwell, and carried, that the application be approved as per plot
plan submitted and on file in the Planning Department, to .allow the follow-
ing encroachments:
6 feet into the front yard setback
5 feet into the side street yard setback
17 feet into the rear yard setback
and reduction of 5 feet for distance between the residence and the
garage, subject to the following conditions:
1. The garage be physically attached to the dwelling in a manner
approved by the Building Department or the area between the
structures be enclosed and made a part of the dwelling.
2. An encroachment permit be obtained from the Public Works
Department for the fence encroachment into the street right-
of-way.
In accordance with Section 17.64.010 of the Bakersfield Municipal Code,
the granting of a Modification by the Board of Zoning Adjustment shall be
final unless within ten (10) days after the decision by said Board, the
applicant or any other person aggrieved shall appeal therefrom in writing
to the City Council by presenting such appeal to the City Clerk,
1501 Truxtun Avenue, Bakersfield, California. Filing fee for appeal is
$275.00 and must be included with the first appeal. If all appeals are
withdrawn prior to hearing by the city council the hearing will not be con-
ducted and further permits for this project may be granted.
No permit or license shall be issued for any use inv-olved in an appli-
cation for Modification until same shall have become final by reason of the
failure of any person to appeal or by reason of the action of the City
Council.

SUBJECT: ENCROACHMENT PERMIT APPLICATION-
ART DONSBY, 2701 PINE ST.
We have reviewed the subject encroachment permit application. This
is an existing 6' high wood fence in the side yard (Hubbard St.
frontage) at 2701 Pine St. The fence is built clear of the corner
cut-off for sight line and 5' behind the curb. Based on the
information ~rovided and a field review, I recommend approval of
the application.
