Applicant agrees that if this application is granted, applicant will indemnify,
~/r~),~~e and hold harmless the City of Bakersfield, its agents, officers and
/ employees against and from all damages, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.

application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said

SUBJECT: ENCROACHMENT PERMIT APPLICATION-
THOMAS BARRIE, 22 DUNLAP STREET
The subject applicant has requested an encroachment permit to
construct a masonry block wall wi thin the right-of-way. His
initial application was re~ommended for denial based on the wall
encroaching into the 60' by 60' sight triangle for uncontrolled
intersections. Mr. Barrie' has since written our department
requesting a variance to the sight line requirements allowing him
to complete the wall which is currently under construction.
The street on which the sight encroachment would affect is a
relati vely short cul-de-sac. The cross street acts as a local
collector thereby making the operation of the intersection similar
to a double "Tee" intersection. There is very little straight
through traffic across the local collector. Based on this
configuration and existing operation, the encroachment should not
pose a hazard to traffic utilizing the intersection. Therefore, I
recommend approval of the encroachment based on the information
outlined above.
