application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said\
public property or right of way to the condition;as nearly may be in which it was
before the placing, erection, maintenance or existence of said encroachment.

Dear Mr. Moore-Leavitt:

Pursuant to my client's telephone conversation with you on
1/5/90, this letter constitutes an objection to the five (5)
foot fence you are planning to put in the front yard of your
residence at 4100 University Avenue. The planning department
allows a fence no higher than four (4) feet in the front yard.
We have no objection to a four foot fence. The Giannantonios
will reroute their sprinkler system to accommodate your fence.
As to your restriction expressed in the telephone conversation
with Mrs. Giannantonio on 1/5/90, they will not be coming onto
your property to remove the sprinkler pipe on your property. You
may cut bushes down on your property line only.
The City Planning Department and Jaguar Construction have been
notified of my client's objection to your proposed illegal fence.
