Pursuant to the provisions of Ordinance No. 3140 New Series of the City of
Bakersfield, the undersigned applies for a permit to place, erect and/or maintain
an encroachment on public property or right qf way as therein defined.

Applicant agrees that 1f this application is granted, applicant will indemnify,
r/~/r~~~pve and hold harmless the City of Bakersfield, its agents, officers and
employees against and from all damages, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way to the condition as nearly may be in which it was
before the placing, erection, maintenance or existence of said encroachme~t.

I am writing to express my concern about some slope stability problems
associated wi'tll the City' s Maintenance Di stri ctNo. 18 tn northeast
Bakersfield. TEd's' distri'ct 1 i'es along the::norfb:edge;:';6f' the Skyridge
subdi.vision and was: set up to maintain the slope stabil ity of recompacted

The slopes, of the Maintenance District are beginning to s.how erosion
due to off-road vehicle play, kids walking and sl1ding downhill, kids
buildfngforts, etc. Just a few days ago, I had to ask a dune-buggy
driver to go do his thing somewhere else. He w_as doing wheel-spinning
hillcl imbs up tile slopes of tbe Maintenance District. These traffic
areaS are nOK devotd of vegetation. Small gullies will eventually form
along thes.e traffi'c paths:, threatening fencing, backyards, sidewalks at
the end of cul-de-sacs, etc., not to mention the bad visual impacts to
our City and neighborhood. The natural grass landscaping that was done
after the recompaction would probably be OK, but it cannot stand up to
this kind of trafftc.
Obviously, I bave a vested interest in maintaining th.e integrity of my
homesite, but r would hate to s.ee the other portions. of the, slopes
deteriorate also. . The best solution would be to set up an 'irrigation
,system and 1 andscape wi'tll tough groundcovers and bushes. However, I
real ize that thts would be expensive. In the interim, I propose that
the City allow me to plant and sprinkler irrigate the portion of the
~~__"_~!1aintenance District adjacent to my lot. I would do this at my own

gazanias, etc. or plants acceptable to the Publ1c Works Department.
I have discussed the problem and my proposal with Mr. Don Hoggatt of the
Publ ic Works Department, who was very hel pful in expl a i ning the
Maintenance Dtstrict and providing the attached map. I suggest that
Publ ic Works may want to tnvestigate the situaUon further and keep an
eye on thes.e slopes. I aw~H the City's reply to my propo~al. Please
