Bakersfield, the undersigned applies for a permit to place, erect and/or maintain
an encroachment on public property or right of way as therein defined.

Applicant agrees that if this application is granted, applicant will indemnify,
~L~~~saN{ and hold harmless the City of Bakersfield, its agents, officers and
r ~ployees against and from all damages, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way to the condition as nearly may be in which it was

I hereby certify that I have made an investigation of the facts stated in the
foregoing application and find that the maintenance of said encroachment (1)

The Public Works Department's policy will allow fencing and landscaping within
the public right of way which is adjacent to the rear property line of the
subject residence, with the following conditions:
1. The fencing plans must be ~~~:i by Public Works prior to start of
construction.
2. A Street Use Permit must be obtained from Public Works ih order to work
within the street right of way. The fee for this permit is $45.00.
3. The fencing materials must be aesthetically ,pleasing and should be
compatible with other fencing in the area.
4. An Encroachment Permit must be obtained from Public Works for any permanent
facilities placed in the right of way, such as fences, irrigation system
sand any structures contemplated. The fee for this permit is-$60.-rrO~

Consideration for placement of a'small redwood deck within this area can be made
with a future application.

At the rear of the above residence is an embankment and a
1 BV e 1 area, beyond the hous e fence line, wh i ch borders t h(~
Harrell Highway cutoff. The bank goes from about eight to
perhaps fifteen feet in height as the road descends from.West to
East. The City periodically scrapes the level portion and picks
u~ trash which accumulates theres apparently secondary t6 dump
and park traffic. There has been' some gullyfol'mation and
s Iou g h i n g of mud from the bank . At present , the b a nle all die vel
areas are both a maintenance problem ~nd unattractive.
Several lots further East: have extended their fences over
the 'brow of the embankment., and have 1 andscaped and improved the
bank. The landscaping on a couple of the lots includes deckiug
ar'eas level with the top of lhe bank and extending moderately
out,with plantings below. This of course reduces the al'ea
which City must maintain, will aid erosion control and enhance
the appearance both for myself, my neighbors and persons using
the Harrell Highway.
My family and I would like to extend our rear fence to the bottom
of the embankment, or perhaps five to ten feet beyond. We would
then utilize plants on the embankment suitable to the soil and
weather, with go~d soil-hold chtliacteristics. At the base, we
cIlvisi on shrubs or perhaps a fc\v ornamental trees. The fencing
Pl'oposed would be wrought iron dO\'Hl the bank to belo\v the line of
vision, and chain link parallel to the road. Shrubbery near the
chain link is planned, to "soften" its appearance. \'le an~
undecided about the use of any decl<ingj the only suggestion Wl:
