Bakersf1eld, the undersigned applies for a permit to place, erect and/or maintain
an encroachment on public property or right of way as therein defined.

Applicant agrees that if this application is granted, applicant will indemnify,
,'rI i,....;lsa~e' and hold harmless the City of Bakersfield, its agents, officers and
~mployees against and from all damages, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance qf said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.

Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way to the condition as nearly may be in which it
before the placing, erection, maintenance or existence of/sAid encroachment.

SUBJECT: This is the time set for a continued public hearing on
Resolution of Intention No. l027 declaring its intention
to order the abandonment of a 100-foot portion of dedicated
vehicular access rights along the north right of way line
of Alfred Harrell Highway approximately 1 mile west of
Lake Ming Road.
RECOMMENDATION:
Motion not to adopt and to terminate any further action
on Resolution of Intention No. 1027.
Roll Call Vote.
ALTERNATIVES AVAILABLE TO COUNCIL:
To adopt resolution
or
Issue an encroachment permit.
IMPLICATIONS OF ALTERNATIVES:
By issuing a temporary encroachment permit permanent
access to a major arterial will be limited.
ISSUE:
Shall motion be passed to NOT adopt resolution?
BACKGROUND:
This hearing has been continued from the meetings of
July l, August 12, September 9, and October 21, 1987.

Hearings
The 'California Living Museum (CALM) requested that the
City allow a vehicular access opening along a portion of
the north side of Alfred Harrell, approximately 1 mile
west of Lake Ming Road, originally closed to vehicular
access rights by dedication.
It is the intent for the applicant to request a temporary
encroachment permit limited ~o completion of the proposed
interchange at Morning Drive and Alfred Harrell Highway.
ALL pertinent background material is available in the Clerk's
Office and will be available at the Council Meeting. This material
should be reviewed.

Committee, read Urban Development Committee Report No. 24-87 re-
qar:hng Ac:::ess to the California Living Museum from Alf:::-ed Harrell
Highway as follows:
A le~~er was received from the California Living
Musewn reques~ing the City abandon a 100-foo~ por-
~ion of dedicated vehicular access rights along the
nor~h right of way line of Alfred Harrell Highway
for direct access to the California Living Museum.
~his reques~ was referred to the Urban Development
Comrr.i~~ee for review and recommendation.
~he requested access location is 2200 ree~ east of
the future Mor~ing Drive intersec~ion wi~h Alfred
Harrell Highway. The staff recommends that any
connec~ion nea= C~~ be n~em~o=arv" in that it
would be closed when access is de;eloped at the
Morning Drive alignment. The staff is or ~he opin-
ion that a terr.~orary access could best be accom-
plished by the granting of an encroachment permit.
Therefore, this Committee recommends that the City
Council not proceed with the abandonment of the
vehicula~c:::ess rights. CAL~ could then proceed
with a temporary encroachment permit limited to
completion of th~ proposed interchange at Morning
Drive and Alfred Barrell Highway.
Mayor Payne opened the hearing for public participation.
No protests or oejections being hearo and no one wishing'
to speak in favor, Mayor Payne closed the public por~ion of the
hearing for Council deliberation and ac~ion_
