Applicant agrees that if this application is granted, applicant will indemnify,

employees against and from all damages, judgments, claims, demands, expenses,

agents or employees, proximately caused by, growing out of or in any way

applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way to the condition as nearly may be in which it was
before the placing, erection, maintenance or existence of s~id encroachment.

PROJECT NAME: Modification #4783

LOCATION: 4131 Parker Street
PROJECT DESCRIPTION:
A Modification to permit a five foot high brick and wrought iron
wall within the required 25-foot front yard setback on both sides
of a double frontage lot where the maximum allowable wall height
is four feet in an R-l (One Family Dwelling) Zone.
ENVIRONMENTAL SETTING:
The site is in an area depicted as Low Density Residential on the
Land Use Map of the Bakersfield Metropolitan Area General Plan.
The site has street frontage on the east, west and north sides.
The area west and north is zoned R-3 (Limited Multiple Family
Dwelling) and developed with apartments. The area to the south
is zoned and developed as single family residential and the area
to the west is zoned R-l and vacant.
PROJECT ANALYSIS:
The proposed fence surrounds the property on the three street
frontages and encloses the residence and a legal non-conforming
contractor's storage yard. The fence has been partially
constructed, when completed, the fence will be comprised of a low
solid brick wall with 5 foot high pilasters spaced approximately
15 feet apart; the area between the pilasters will be wrought
iron. The wrought iron should leave sufficient visability for
vehicular activity. Curb returns have been constructed at both
corners, including handicap access. The frontages along oriole
Street, Parker Avenue and San Marino Avenue do not have curb,
gutter and sidewalk. The parcel to the so~th, on oriole Street
and most of the parcels along Parker Avenue have curb, gutter and
sidewalk existing. Parcels along San Marino Drive do not have
curb, gutter and sidewalk. Staff recommends a condition be added
requiring the applicant to construct curb, gutter and sidewalk
along Oriole Street to match the property to the south~ and along
Parker Avenue with the sidewalk running to the base of the wall
and tied into the existing curb returns.
The project is categorically exempt under Article III, Class 5
(d) of Council Resolution 107-86.

PUBLIC CONTACT:
All property owners within 300 feet of subject property have been
noticed. Staff has not received any response regarding said
notice.
FINDINGS:
Staff recommends the following findings be made:
1. The granting of this modification would not be injurious
to property or improvements in the zone or vicinity in
which the property is located.
2. The granting of such modification is necessary to secure
appropriate improvements on the lot or lots.
3. The granting of the modification is consistent with the
purpos~s and intent of Title 17 of the Bakersfield
Municipal Code.
The findings are based on the following facts:
1. The fence will be an attractive addition to the
neighborhood.
2. The fence will help hide an unattractive non-conforming
use.
3. The condition of approval will insure the project will
blend well with the neighborhood.
RECOMMENDED ACTION:
Motion to adopt Resolution #71-88 and approve the Modification
with findirtgsdescribed on Page 15 of the staff report subject to
the following condition:
1) The applicant spall construct curb, gutter and
sidewalk along Oriole Street to match the proper~y
to the south. Curb, gutter and sidewalk shall be
constructed along Parker Avenue to the base of the
fence and shall be tied into the existing curb
returns. The applicant must obtain the necessary
permits from the Public Works Department prior to
said construction.
