(c L~ I~I NOTICE OF DECISION BOARD OF ZONING ADJUSTMENT OF THE CITY OF BAKERSFIELD At a regular meeting held May 26,1987, the Board of Zoning Adjustment of the City of Bakersfield considered the application of THE FIRST UNITED METHODIST CHURCH requesting a Conditional Use Permit of an R-1 (One Family Dwelling) Zone to allow parking on the 20-foot wide drainage right-of-way located along the easterly side of the church property on that certain pro- perty commonly known as 4600 Stockdale Highway. At the conclusion of the hearing on the application, it was moved by Member Oberholzer,and carried, that the application be approved as per plot plan submitted and on file in the Planning Department, subject to the following conditions: 1) The proposed project shall comply with the condi- tions of the Site Plan Review approval attached to the staff report. 2) A six-foot high masonry wall, measured from inside grade, shall be constructed along the east right- of-';Jay line of easement where it abuts residen.- tially zoned lots. 3) The applicant shall obtain an encroachment permit from the City. In accordance with Section 17.64.010 of the Bakersfield Municipal Code, the granting of a Conditional Use Permit by the Board of Zoning Adjustment shall be final unless within ten (10) days after the decision by said Board, the applicant or any other per,son aggrieved shall appeal therefrom in writing to the City Council by presenting such appeal to the City Clerk, 1501 Truxtun Avenue, Bakersfield, California. Filing fee for appeal is $105.00 and must be included with the appeal. Staff Reports, BZA, 5/26/87 AGENDA ITEM t 3A2) 4600 STOCKDALE HIGHWAY -- A CONDITIONAL USE PERMIT TO ALLOW PARKING ON THE 20-FOOT WIDE DRAINAGE RIGHT-OF-WAY LOCATED ALONG THE EASTERLY SIDE OF THE CHURCH PROPERTY IN AN R-l (ONE FAMILY DWELLING) ZONE. (FILE 4627 - THE FIRST UNITED METHODIST CHURCH) (Negative declaration on file) Subject property is a 20-foot wide drainage easement which was created in 1968 when the abutting property owner to the west gave it to the County of Kern. The applicant is in the process of obtaining permission from the city to park on subject easement. The applicant will bring in approximately two feet of fill dirt .to raise the easement up to the existing grade of the church property. The easement will be paved and a six-foot high masonry wall will be erected along the east right-of-way line of the easement where it abuts residential zoned lots. As of May 21, 1987, the staff has received only one adverse communication in response to the notices sent out for this hearing. The adverse communication was from Mrs. Arguedas who stated there is already a flood problem when it rains hard at the intersection of McDonald Way and Stockdale Highway. . The Public Works Department calculated the amount of runoff from this portion of the easement to be .3 CFS which is a minimal amount compared to the total amount going into the stormdrain in Stockdale Highway near McDonald Way. After a preliminary environmental assessment, the staff determined the project would not have a significant adverse effect on the environment. A Negative Declaration was posted and advertised on May 15, 1987. Incorporating subject portion of the easement into the church parking lot will be an improvement to the area. The easement is a 20-foot wide no-man's strip with fences along both sides. The gate closest to Stockdale Highway is broken thus allowing access to anyone who wants to enter.
