Applicant further agress that upon the expiration of the permit for which this application is made,
if granted, or upon the revocation thereof by the City Council, applicant will at his own cost and expense
remove the same from the public property or right 0 f way where the same is located, and restore said

SUBJECT: ENCROACHMENT PERMIT FOR VALLEY PLAZA
Attached is correspondence from Pete Ramirez, General Manager
of the Valley Plaza requesting the Council approve their
application for an encroachment permit. This item was pulled
from the June 4th meeting. The application has been modified
to accomodate the Golden Empire Transportation's transfer
facility in the event the site is chosen for the transfer
facility.
If the Council determines that this is an item that arose,
after the agenda was prepared the encroachment permit should
ibe added as item lO.m. page 6 of the Consent Calendar.

VALZA CORP. (VALLEY PLAZA)
Dear Councilman Childs:
This letter will confirm that Valley Plaza will delay con-
struction of the portion of its new south perimeter block
wall lying adjacent to the City!s sump site for 120 days.
The purpose of the delay is to allow sufficient time for
consideration of the use of the sump site for Golden Empire
Transportation's transfer facility., In the event the sump
si te is chosen for the transfer facility, Valley Plaza will
cooperate in any changes in the design of the perimeter wall
at the sump site to accommodate the transfer facility.
In the meantime, we would like to proceed with the completion

and, therefore, we respectfully request that our application
be approved.

SUBJECT: Application for Encroachment Permit for the following:
Valza Corp. (Valley Plaza), 2701 Ming Avenue, Bakersfield,
CA 93304. The applicant is requesting to construct a
6 fL concrete block wall behind the property line which
requires 1'-2" subgrade footing into the alley along the
south side of property.
RECONMENDATION:
Since the encroachment .will not interfere with pedestrian
or vehicular traffic. the Public Works Department recommends
approval of the application.
BACKGROUND:
ALL pertinent background material is available in the Clerk's Office
will be available at the Council Meeting. This material should be
reviewed.
