The undersigned purchased Lot 25, Tract 4603, April 1983, from Homestead Land Development Corporation, the prime developer of tract 4603. The existing house and swimming pool were constructed approximately twenty years ago with no gas service or pool heater. It is the desire of the undersigned that the pool be heated. The underground utility phase of development of the tract in- cluded gas servLce to the rear yard of Lot 25. We have expended considerable sums for landscaping the yard and in addition, have planted approximately fifty trees outside the block wall at the norther1,y-_.' property boundary. It is preferred that we not have to trench across the rear yard and/or remove or destroy the trees in,order to place the gas line to the heater. As shown on the attached plot plan, the property line is ten feet from the flow line and the existing wall is eleven feet. It is most feasible to place the gas line eight feet from the flowline, a two foot encroachment, in order to be away from the trees and still sufficient distance from the sidewalk that there are no apparent problems created, maintenance or otherwise. The entire strip is planted with ground cover in addition to the tre.s and is irrigated.
