Pursuant to the provisions of Ordinance N6.3140 New Series of the City of
Bakersfield, the undersigned applies for a permit to place, erect and/or
maintain an encroachment on public property or right of way as therein defined.

The nature or description of the encroachment for which this application is
made is as follows: TO INSTALL AND BURY A 6-INCH GAS PIPELINE OF SCH. 80 CARBON
: STL AT LEAST 4 FT BELOW EXISTING GRADE. THE GAS LINE WILL BE PARALLEL TO THE
I PALADINO DR. SOUTH RIGHT-OF-WAY LINE FOR APPROX.200 FEET. APPLICANT
UNDERSTANDS THAT UPON FUTURE STREET CONSTRUCTION, APPLICANT WILL BE RESPONSIBLE
FOR LOWERING LINE TO BELOW STREET GRADE (IF NECESSARY) AS REQUIRED BY THE CITY
ENGINEER.
The location of the proposed encroachment is: ON THE SO. SIDE OF PALADINO DR.
WITHIN ~IS_T_INO STREET RIGHT-OF-WAY FROM A POINT OF APPROX.150 FEET E/OF THE
~ID-SECTION LINE OF SEC.13, T29S, R28E, MDB&M TO A POINT OF'ApPROX. 50 FT W/OF
THE'SAME ON SAME ALIGNMENt. (SEE ATTACHED ~XHIBITS 1 AND 2) . .
Applicant agrees that if this application is granted, applicant will indemnify,
defend and hold harmless the City of Bakersfield, its agents, officers and
employees against and from all damages, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such
officers, agents or employees, proximately caused by , growing out of or in any
way connected with the placing, erection or maintenance of said encroachment,
the applicant futher agrees to maintain the aforesaid encroachment during the
life of the said encroachment or until such time that this permit is revoked.
Applicant ftirther agrees that upon the expiration 'of the permit for which this
, application is made, if granted, or upon the revocation thereof by the City
I Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way whe~e the same is located, and restore said
public property or right of way to the condition as nearly may be in which it
was before the placing, erection, maintenance or existence of said
encroachment.

ENCROACHMENT PERMIT APPLICATION FOR THE CROSSING OF PALADINO DRIVE
APPROXIMATELY ONE HALF MILE WEST OF MORNING DRIVE - DESTEC
INSTALLATION OF NATURAL GAS PIPELINE

Engineering staff has reviewed the attached encroachment permit and reco~ds it he approved with the
condition listed on the permit. The permit is to allow the installation of a:jY" diameter natural gas pipeline
that will be parallel to the south side of the Paladino Drive right-of-way (no street improvements currently
exist along this portion of Paladino Drive) for about 200', and then will turn north and cross the street right-
of-way. A condition has been added that the permit applicant will be responsible for lowering the pipeline
in the future, if needed, to construct Paladino Drive. Bob Sherfy of the City Attorney's Office has been
consulted about the need for a pipeline license agreement. He says that because there is such a small amount
of pipeline involved, an encroachment permit would be appropriate.

SPECIAL POWER OF ATTORNEY
KNOW ALL BY THESE PRESENTS: That Bear Mountain Limited,
a Texas limited partnership, ("Principal"), through Bear
Mountain CoGen, Inc., a Texas corporation which is the general
partner of Principal, hereby makes, constitutes and appoints
W.P. Schneider (the "Attorney-in-Fact"), the true and lawful
attorney of Principal to execute and deliver for Principal and
in Principal's name, place and stead and for Principal's use
and benefit certain documents, instruments and agreements with
the City of Bakersfield and the County of Kern relating to the
grants of easements and access rights to Principal for use in
connection with Principal's cogeneration facility to be
located in the City of Bakersfield, Kern County, California,
together with such other agreements, instruments and documents
as the Attorney-in-Fact may deem necessary or appropriate in
connection with such grants of easements and access rights to
Principal.
Principal hereby grants to the Attorney-in-Fact full
power and authority to do and perform each and every act and
thing which may be necessary or convenient, in connection

Principal might or could do if personally present, hereby
