THAT WE, CASTLE & COOKE HOMES, INC., a California corporation,
as Principal, and AMERICAN HOME ASSURANCE COMPANY, a corporation
organized under the laws of the State of New York, and duly
authorized under the laws of the State of California to become sole
surety on bonds and undertakings, as Surety, are held and firmly
bound unto the CITY OF BAKERSFIELD, as Obligee, in the full and
just sum of Ten Thousand Nine Hundred Thirty-Nine and nO/100
Dollars ($10,939.00), lawful money of the United States of America,
to be paid to the Obligee, successors or assigns J jointly and
severally, firmly by these presents.
THE CONDITION OF THE ABOVE OBLIGATION is such that whereas the
said principal has entered into a contract of even date herewith
with the said Obligee to do and perform the following work, to wit:
Improvements within Tract No. 4902 Phase E - Restoration of
Accepted Improvements, Kern County, California and is more
specifically set forth in said contract, to which contract
reference is hereby made.
NOW, THEREFORE, if the said Principal shall well and truly do
the said work, and fulfill each and every one of the covenants,
conditions and requirements of the said contract in accordance with
the plans and specifications, then the above obligation to be void,
otherwise to remain in full force and effect.
No right of action shall accrue under this bond to or for the
use of any person other than the Obligee named herein.

WHEREAS, the City Council of the City of Bakersfield, State of
California, and CASTLE & COOKE HOMES, INC., a California corporation,
(hereinafter designated as "Principal ") have entered into an agreement
whereby Principal agrees to install and complete certain designated public
improvements', which said agreement dated , and identified
as Tract No. 4902 Phase E - Restoration of Accepted Improvements, Kern
County, CA, is hereby referred to and made a part hereof; and
WHEREAS, under the terms of said agreement, Principal is required before
entering upon the performance of the work, to file a good and sufficient
payment bond with the City of Bakersfield to secure the claims to which
reference is made in Title 15 (commencing with Section 3082) of Part 4 of
Division 3 of the Civil Code of the State of California.
NOW, THEREFORE, said Principal and the undersigned as Surety, are held
firmly bound unto the City of. Bakersfield and all contractors,
subcontractors. laborers, materialmen and other persons employed in the
performance of the aforesaid agreement and referred to in the aforesaid Civil
Code in the sum of Five Thousand Four Hundred Seventy and nO/100 Dollars
($5,470.00) for materials furnished or labor thereon of any kind, or for
amounts due under the Unemployment Insurance Act with respect to such work or
labor, that said Surety will pay the same in an amount not exceeding the
amount hereinabove set forth, and also in case suit is brought upon this
bond, will pay, in addition to the face amount thereof, costs and reasonable
expenses and fees, including reasonable ateorney's fees, incurred by City in
successfully enforcing such obligation, to be awarded and fixed by the court,
and to be taxes as costs and to be included in the judgment therein rendered.
It is hereby expressly stipulated and agreed that this bond shall inure
to the benefit of any and all persons, companies and corporations entitled to
file claims under Title 15 (commencing with Section 3082) of Part 4 of
Division 3 of the Civil Code, so as to give a right of action to them or
their assigns in any suit brought upon this bond. Should the condition of
this -bond be fully performed, then this obligation shall become null and
void, otherwise it shall be and remain in full force and effect.
Surety hereby stipulates and agrees that no change, extensions of time,
alteration or addition to the terms of said agreement or the specifications
accompanying the same shall in any manner affect ies obligations on this
bond, and it does hereby waive notice of any such change, extension,
alteration or addition. ~
