Bakersfield, the undersigned applies for a permit to place, erect and/or maintain

Applicant agrees that if this application is granted, applicant will indemnify,
defend and hold harmless the City of Bakersfield, its agents, officers and
employees against and from all damag~s, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately 'caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of,the said encroachment or until such time that this permit is revoked.

Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said

On October Xl, 1992 a request was made by David Milazzo of MilaZzo and Associates for a
modification to the street tree p~tings at the above named project. .
On February 3, 1992, the Central District Development Agency reviewed the application: Street
ttees, 24 inch box were to be planted at 3~ foot inte1'Vals on center around the building. The
specific number of trees to ~ p~ was not specified.

Asoutlilled in a letter submitted to me from Mr. Milazzo, the request for Jl1Odilication is due to
the minim81 space ~ the alley and the curb cut.on 22nd Street. The omission of the tree
will bring. the total number of trees for the project to seven.
Mter reviewing .this request staff approves the request to omit one tree at the northeast comer
of 22nd Street and the alley. I bave iDitialed tbree sets .of plans approving this request.

As contained in Exhibit "A" of the Board of Zoning Adjustment's Resolution No, 13-92 there
are six DISCRETIONARY CONDmONS.
Concl1tlon '2 requires 24" box trees at 35 foot intervals on O\ester Avenue and 22nd Street.
Due to the minimal space between the alley and curb cut on 22nd street. please accept this
request to omit the tree previously shown in that location. This will bring the total number of
trees requtred for the project to seven.
Condition '3 required the modification of the curb in front of the Main entrance. Please
ac:c:ept this request lor a wavier of that condition.
. These two conditions originated at the COOA meeting and were included in the CUP
conditions as discretionary. Thank you for you attention.to this matter and your continuing
