Pursuant to the provisions of Ordinance No. 3140 New Series of the City of
Bakersfield, the undersigned applies for a permit to place, erect and/or maintain

Applicant agrees that if this application is granted, applicant will indemnify,
defend and hold harmless the City of Bakersfield, its agents, officers and
employees against and from all damages, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicapt further agrees to maintain the aforesaid ~ncroachment during the life
of the said encroachment or until such time that this permit is revoked.
Applicant further agrees that upon the expiration of the permit for which tois
application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way to the condition as nearly may be in which it was

SUBJECT: ENCROACHMENT PERMIT APPLICATION
JAGMOHAN SINGH Sr'DHU, 3920 PHAFFLE DRIVE
We have reviewed the subject encroachment permit application. The
applicant is requesting an encroachment permit to construct a wood
fence along his side and front yards. The side yard fence is
proposed to be 6 feet in height and the front yard fence is
proposed to be 3 feet in height.
Staff has met the applicant at the si te and performed a field
review of the proposed encroachment. Based on the field review and
attached,sketch, ~ recommend approval of the proposed encroachment
subject to the following conditions:
1. Applicant can construct fence no more than seven (7) feet
from his property line.
2. Side yard fence along San Marino Street must be
constructed such that existing down guy is on street side
of the fence unless written permission is obtained by
P.G. & E. allowing down guy to remain within fenced yard
area.
3. Fence must be constructed per attached sketch.

We have reviewed the subject encroachment permit application. The
applicant is requesting an encroachment permit to facilitate an
existing concrete stairway within the right-of-way. This stairway
was left in place after the widening of H Street and represents an
existing non-conforming encroachment.
