WALKER, TRAFFIC ENGINEER~ SUBJECT: ENCROACHMENT PERMIT APPLICATION ROBERT & PEGGY DeFOOR, 5101 EASTRIDGE COURT We have reviewed the subject encroachment permit application. The applicant is. requesting approval to construct a retaining wall and 6' high wood fence along the back of sidewalk in their side yard. Our original field review indicated the wall would be acceptable in its place and the fence allowed if it were set back to maintain proper sight line. We wrote a letter to the applicant indicating the results of our initial review. The letter also indicated additional information was needed to process the application. Based on the information received, I recommend approval of the application subject to the following conditions: 1. The 6' wood fence must be constructed a minimum of 5' - 3" south of the back of sidewalk on Auburn Street. 2. The area between the top of wall and fence may be planted wi th ground cover. DIRECTOR · CITY ENGINEER July 9, 1992 Robert and Peggy DeFoor 5101 Eastridge Court Bakersfield, CA. 93306 RE: ENCROACHMENT PERMIT FOR RETAINING WALL Dear Mr, & Mrs. DeFoor: We have reviewed your encroachment permit application to construct a retaining wall and fence along the back of sidewalk of Auburn Street. The proposed wall and fence are within the necessary line of sight for northbound vehicles wishing to turn onto Auburn Street. Therefore, modifications to your original plan are necessary to comply with current city standards. These modifications are as follows: 1. The fence that is proposed to be constructed on top of the retaining wall along the back of sidewalk may be placed no closer than 5 feet;, 3 inches form the back of sidewalk, 2, The existing retaining wall along the back of sidewalk may remain in place. The area between the wall and fence may be used to plant turf or low growing ground cover, Under no circumstances shall ground cover be allowed to grow above the existing top of retaining wall. If ground cover is found to be growing above the top of retaining wall, the City will remove such ground cover and charge you for any costs incurred. 3. Our visual inspection indicates the retaining wall was constructed over an existing water main and cable television line. Other utilities may exist under the wall as well. Since these utilities are within the Franchise area, we must received written permission from them that the wall will not interfere with m?intenance of their facilities. Please obtain written permission from all utility companies which have facilities under the existing wall that the wall will not interfere with their operations, Once we have received the necessary information, we will process the encroachment permit with the above restrictions. The wall is constructed within a PG&E easement and therefore in conflict with our underground gas and electric facilities installed parallel with the wall along the back edge of the sidewalk. Please be aware that if we ever need to work on these facilities the wall may have to be taken down without any liability on our part to repair or rebuild it.
