App~~cant agrees that if this application is granted, applicant will indemnify,
defend and hold harmless the City of Bakersfield, its agents, officers and
employees against and from all damages, judgments, claims, demands, expense~,
costs and expenditures, and against all loss or liability which the City of"
Bakersfield or such officers, ~gents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erection or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.
~ Applicant further agrees that upon the expiration of the permit for which this
application is made, if granted, or upon the revocation thereof by the City
Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way in the condition as nearly may be in which it was
before the placing, erection, m~ancejOr existence of said encroachment.

SUBJECT: ENCROACHMENT PERMIT APPLICATION
ANDY YOUNG, 6600 HORNITOS COURT (93309)
We have reviewed the subject encroachment permit application. The
applicant is requesting approval to construct a small retaining
wall and a 6' tall wood fence behind the existing sidewalk. The
wood fence would be 6' tall as measured from the house side.
Based on our field review, attached sketch and signatures of nearby
property owners, I recommend approval of the subject encroachment
permit w~th the following note:
"I f at a future date, the homeowner chooses to construct a
drive approach to access his side yard, the proposed retaining
wall and fence shall be modified to include a 10' X 10' corner
cut-off for sight visibility."
