Pursuant to the provisions of Ordinance No. 3140 New Series of the City of
Bakersfield, the undersigned applies for a permit to place, erec~ and/or maintain
an encro~chment on public property or ri~ht of way as therein defined.

Applicant agrees that if this application is granted, applicant will indemnify,
, defend and hold harmless the City of Bakersfield, its agents, officers and

e~ployees against and from all damages, judgments, claims, demands, expenses,
costs and expenditures, and against all loss or liability which the City of
Bakersfield or such officers, agents or employees may suffer, or which may be
recoverable from, or obtainable against the City of Bakersfield or such officers,
agents or employees, proximately caused by, growing out of or in any way
connected with the placing, erect10n or maintenance of said encroachment, the
applicant further agrees to maintain the aforesaid encroachment during the life
of the said encroachment or until such time that this permit is revoked.
Applisant further agrees that upon the e~piration of the permit for which this
,application is made, if granted, or upon 'the revocation thereof by the City
'Engineer, applicant will at his own cost and expense remove the same from the
public property or right of way where the same is located, and restore said
public property or right of way to the condition as nearly may be in which it was
before the placingt erection, maintenance or existence of said encroachment.

EXHIBIT, "A"
To insure uniformity' of the slopes in this area the' following
conditions shall apply:
1. All fences within the slope area shall be
6' chain link (11 gauge minimum) and
located 10' (measured horizontally) from
the top of the slope.
2.
No permanent structures, other
fencing, shall be installed
constructed within the slope area.

over the fence will be allowed. Removal
of tumbleweeds and other debris from the
fence and the encroachment area, shall be

4. Shrubs and ground cover will be permitted
in the slope area.
5. Irrigation systems and control of
irrigation within the encroachment area
must be approved by the City Public Works
Department. Extreme care shall be
exercised in irrigating the slope area to
prevent erosion. Inadvertent erosipn of
the slope either inside or outside the
fence caused by the action of the
property owner, , shall be repaired
promptly by the owner. Failure to repair
damage due to erosion may result in the
City making the riecessary repairs and the
owner being charged for the work done.
6. No permanent property rights are conveyed
. to the owner due to granting of this
slope easement.
