ROLL CALL Present: Councilmember Zack Scrivner, Chair Councilmembers Harold Hanson and Ken Weir Staff present: Virginia Gennaro, City Attorney Michael Richards, Associate Attorney Rhonda Smiley Assistant to the City Manager Steven Teglia, Administrative Analyst III Jim Eggert, Assistant Planning Director Chris Lee, Building Department Others present: James Geluso, Bakersfield Californian Dianne Hardisty, Bakersfield Californian Peter Samore, KUZZ Brian Todd, WPR Builder Services Chuck Dennis, KBAK 2. ADOPT THE AUGUST 20, 2007 MINUTES OF THE SPECIAL MEETING OF THE PLANNING AND DEVELOPMENT COMMITTEE FOR THE PURPOSE OF MEETING WITH THE JOINT CITY/COUNTY TRANSPORTATION TASK FORCE Ado,~p.ted as submitted. Review and Discussion of Ordinance Relating to Electronic Message Signs -Gennaro / Grady City Attorney Gennaro stated that the revised ordinance was prepared by Jim Eggert, Building Department, and it is ready to be presented to the Planning Commission for review and approval. Committee members approved staff's recommendation and motioned that the revised ordinance be sent to the Planning Commission. Committee member Harold Hanson commended staff for a job well done. 6. NEW BUSINESS A. Discussion Regarding Construction Workmanship Levels A memorandum from the City of Clovis Building Division regarding Construction Defect Litigation, was submitted to the City Manager's Office and the Development Services Department. City Attorney Gennaro does not see an epidemic of defect litigation in the City; therefore, she advised that this type of memorandum would not be necessary for the City at this time. From a legal perspective, it would expose the City to a new area of liability. Committee Chair Zack Scrivner stated that the Home Builders Association representatives requested this item be placed on the Committee Agenda, although they did not attend the meeting. Should Home Builders' Association wish to have this item addressed in the future, they may put in a request to the Committee. 7. CO'IWIMITTEE COMMENTS None 8.
