HomeMy WebLinkAboutRES NO 93-77RESOLUTION N0. 9~o-77 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD REQUESTING CONVEYANCE OF EASE- MENT IN CERTAIN REAL PROPERTY FROM MOUNT VERNON COUNTY SANITATION DISTRICT TO CITY OF BAKERSFIELD FOR VALUABLE CONSIDERATION. WHEREAS, the City of Bakersfield is the recipient of a Clean Water Grant from the Federal Government to assist in develop- ing an effective wastewater management plan for the area served by City of Bakersfield Wastewater Treatment Plants, Nos. 1 and 2, and the City is in the process of implementing the project, which includes the consolidation of Plants 1 and 2 at the No. 2 Plant, and the upgrading and expansion of Plant No. 2, to provide sewage treatment, consisting of primary sedimentation followed by aerated lagoons, the effluent from which is to be used for irrigation of restricted crops on land purchased and developed for such purposes; and WHEREAS, it is urgently necessary that the City of Bakers- field acquire the use of additional land as an integral part of the project to provide a connecting link from the land upon which the wastewater treatment plants are located to the land receiving the effluent from the modified and expanded wastewater treatment facilities; and WHEREAS, the public use for which such additional land is needed is for public utility facilities, to lay, construct, operate, maintain, repair, reconstruct, change the size of and remove sani- tary sewer pipe lines or conduits, and appurtenant and necessary surface and subsurface structures, fittings and other equipment and for vehicular and pedestrian travel in, under, across, over and upon those certain strips and parcels of land in'the ~inc~rpora~ed-.~rea"of Kern County, California, more particularly described as follows: A portion of the west half of Section 27, Town- ship 30 South, Range 28 East, Mount Diablo Base and Meridian, County of Kern, State of California, described as follows: PARCEL 1: PARCEL 2: PARCEL 3: PARCEL 4: PARCEL 5: PARCEL 6: The west 30 feet of said Section 27, EXCEPTING THEREFROM the portion within the Arvin-Edison Canal right-of-way as shown on that certain map designated 4-1 Arv.Ed. 2 M1 on file in the office of the Kern County Surveyor and also, EXCEPTING THEREFROM the north 30 feet. The south 30 feet of the west 1365 feet of said Section 27. A portion of the northeast quarter of Section 10, Township 30 South, Range 28 East, Mount Diablo Base and Meridian, County of Kern, State of California, described as follows: The south 20 feet of the north 35 feet of the northeast quarter of said Section 10. (Construction Temporary Easement) A portion of the west half of Section 27, Township 30 South, Range 28 East, Mount Diablo Base and Meridian, County of Kern, State of California, described as follows: The east 10 feet of the west 40 feet of said Section EXCEPTING THEREFROM the portion within the Arvin-Edison Canal right-of-way as shown on that certain map designated 4-1 Arv.Ed. 2 M1 on file in the .office of the Kern County Surveyor and also, EXCEPTING THEREFROM the north 30 feet. (Construction Temporary Easement) The north 10 feet of the south 40 feet of the west 1365 feet of said section 27. (Construction Temporary Easement) A portion of the northeast quarter of Section 10, Township 30 South, Range 28 East, Mount Diablo Base and Meridian, County of Kern, State of California, described as follows: The north 40 feet of the northeast quarter of said Section 10, EXCEPTING THEREFROM the following: The south 20 feet of the north 35 feet of the northeast quarter of said Section 10. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That the recitals above made in this resolution are true and correct and are incorporated in the body of this resolution as though herein set out in full. 2. That the owner of the property described above, Mount Vernon Sanitation District of Kern Count~ is hereby requested to convey an easement in such property for the purposes specified above, to the City of Bakersfield, in consideration of the payment by the City of the sum of $4,605.00, the appraised value thereof. o0o I HEREBY CERTIFY that the foregoing resolution was passed and adopted by the Council of the City of Bakersfield at a regular meeting thereof held on the 21st day of September, 1977, by the following vote: AYES: COUNCILMEN BARTON, CHRISTENSEN, MEDDERS, RATTY, ROGERS, SCEALES, STRONO NOES: COUNCILMEN: b,~,/L.
