A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD AUTHORIZING THE DIRECTOR OF PUBLIC
WORKS. TO SIGN AN APPLICATION BY THE CITY OF
BAKERSFIELD TO THE PUBLIC UTILITIES COMMISSION
OF THE STATE OF CALIEORNIA FOR AN ORDER AUTHORI-
ZING CONSTRUCTION OF THE SEPARATION STRUCTURE
UNDER THE MAIN LINE TRACK OF THE ATCHISON,
TOPEKA AND SANTA FE RAILWAY ON TRUXTUN AVENUE.
WHEREAS,' the City of Bakersfield, in cooperation with the
Greater Bakersfield Separation of Grade District, proposes to extend
Truxtun Avenue and proposes to construct a new railroad crossing at
separated grades between Truxtun Avenue and the railroad tracks; and
WHEREAS, the City of Bakersfield will arrange financing
with its own funds, California State Grade Separation funds, Federal
Aid Urban funds, and Greater Bakersfield Separation of Grade District
funds; and
WHEREAS, the tracks are the property of the Atchison, Topeka
and Santa Fe Railway Company; and
WHEREAS, no public road, highway or street may be constructed
across the track of any railroad corporation without first having
secured the permission of the Public Utilities Corf~f~ission.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield as follows:
1. The Director of Public Works is hereby authorized to
sign, on behalf of the City of Bakersfield, an application by the
said City to the Public Utilities Commission of the State of California
for an Order authorizing construction of a separation structure under
the mainline track of the Atchison, Topeka and Santa Fe Railway Company
on Truxtun Avenue Extension.

I HEREBY CERTIFY that the foregoing Resolution was passed
and adopted by the Council of the City of Bakersfield, at a regular
meeting thereof held on the 24th day of August, 1977, by the following
vote:
