HomeMy WebLinkAboutRES NO 74-77RESOLUTION NO. 74-77 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, STATE OF CALIFORNIA, ESTABLISH- ING UNDERGROUND UTILITY DISTRICT NO. 5. WHEREAS: (a) By Resolution No. 55-77, adopted on July 11, 1977, a public hearing was called'-TfC~Wednmday, August 10, 1977, at the hour of 8 P.M., in the Council Chambers in the City Hall, Bakersfield, California, to ascertain whether the public necessity, health, safety or general welfare require the removal of poles, overhead wires and associated overhead structures and the under- ground installation of wires and facilities for supplying electric, communication, cable television or similar and associated services, within that certain area, more particularly described as follows: Underground Utility District No. 5. Beginning at the intersection of the westerly line of New Stine Road and the southerly line of Sundale Avenue; Thence westerly, along said southerly line of Sundale Avenue, 530.00 feet; Thence northerly, at right angles, 90 feet to intersect the northerly line of Sundale Avenue; Thence easterly, along said northerly line of Sundale Avenue to intersect the westerly line of New Stine Road, of 150 feet in width; Thence northerly, along said westerly line of New Stine Road to intersect the northerly line of Sarazen Avenue; Thence easterly, along said northerly line of Sarazen Avenue to intersect the westerly line of New Stine Road, of 110 feet in width; Thence northerly, along said westerly line of New Stine Road to intersect a line 100 feet northerly and parallel to the north right-~f-way line of Demaret Avenue; Thence easterly, at right angles, 110 feet to intersect the easterly line of New Stine Road; Thence southerly, along said easterly line of New Stine Road to intersect the northerly line of Belle Terrace; Thence easterly, along said northerly line of Belle Terrace to intersect the extended westerly line of Taylor Street; Thence southerly, along the southerly prolongation of said westerly line of Taylor Street to inter- .sect the southerly line of Belle Terrace; Thence~x~esterly, along said southerly line of Belle Terrace to intersect the easterly line of New Stine Road; Thence southerly, along said easterlyline of New Stine Road to intersect'the northerly line of Fjord Street; Thence easterly, along said northerly line of Fjord Street, 435 feet; Thence southerly, at right.angles, 60 feet to ~n~er- sect the southerly line of Fjord Street; Thence easterly, along said southerly line of Fjord Street, to intersect the easterly line of New Stine Road; Thence southerly, along said easterly line of New Stine Road to intersect the northerly line of Ming Avenue; Thence westerly, along said northerly line of Ming Avenue to intersect the westerly line of New Stine Road; Thence northerly, along said westerly line of New Stine Road to intersect the southerlyline of Sundale Avenue, being the point o.f beginning. (b) Notice of such hearing has been given to all affected property owners as such are shown on the last equalized assessment roll and to all utilities concerned in the manner and within the time required by law; and (c) Such hearing has been duly and regularly held, and all persons interested have been given an opportunity to appear and be heard. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield, that pursuant to Chapter 12.27 of Title 12 of the Municipal Code of the City of Bakersfield, the above-described area is hereby declared an underground utility district and is designated as Underground Utility District No. 5 of the City of Bakersfield. Attached heretO, marked Exhibit "A", and hereby incorporated as a part of this Resolution is a map or diagram entitled as follows: UNDERGROUND UTILITY DISTRICT NO. 5 delineating the boundaries of said District. RESOLVED FURTHER that the Council does hereby fix July 1, 1978, as the date on which all affected property owners must be ready to receive underground service, and does hereby order the removal of all poles, overhead wires and associated overhead structures and the underground installation of wires and facilities for supplying electric, communication, cable television or similar or associated service within Underground Utility District No. 5 no later than September 1, 1978. RESOLVED FURTHER that the City Clerk is hereby instructed to notify all affected Utilities and all persons owning real property within Underground Utility District No. 5 of the adoption of this Resolution within ten (10) days after the date of such adoption. Said City Clerk shall further notify said property owners of the necessity that, if they or any person occupying such property desire to continue to receive electric, communication, cable television, or other similar or associated service, they or such occupant shall, by the date fixed in this Resolution (July 1, 1978), provide all necessary facility changes on their premises so as to receive service from the lines of the supplying utility or utilities at a new location, subject to applicable rules, regulations and tariffs of the respective utility or utilities on file with the Public Utilities Commission of the State of California. Such notification shall be made by mailing a copy of this Resolution, together with a copy of Chapter 12.27 of the Municipal Code of the City of Bakersfield, to all affected property owners as such are shown on the last equalized assessment roll and to the affected Utilities. RESOLVED FURTHER that the Council hereby finds and determines as follows: (1) That the public necessity, health, safety or general welfare requires the removal and undergrounding of poles, overhead wires and associated overhead structures within Underground Utility District No. 5. 3.
