HomeMy WebLinkAboutRES NO 53-77RESOLUTION NO. 53 -77 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD SETTING DATE AND PLACE OF PUBLIC HEARING IN MATTER OF PROPOSED CANCELLATION OF LAND USE CONTRACT WITH RESPECT TO PART OF LAND, UNDER THE WILLIAMSON ACT AND DIRECTING CITY CLERK TO GIVE NOTICE IN ACCORD WITH SECTION 51284 OF THE GOVERN- MENT CODE. WHEREAS, Frank, James and Tony Delfino, on June 20, 1977, filed with this Council, a petition for cancellation of a Land Use Contract as to part of the subject land, which contract was entered into under the Land Conservation Act of 1965 (Williamson Act), and which land is located in County of Kern Agricultural Preserve No. 11. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. That in accordance with the provisions of the Williamson Act, a public hearing on the Petition of Frank, James and Tony Delfino is hereby set for Monday, the llth day of July, 1977, at the hour of 8 P. M. at the Council Chambers in City Hall, 1501 Truxtun Avenue, Bakersfield, California; and 2. That the City Clerk is hereby directed to give notice of the hearing in accordance with Section 51284 of the Government Code; and 3. That the notice as aforesaid shall be in substantially the following form: NOTICE OF PUBLIC HEARING In the Matter of Proposed Cancellation of Land Use Contract with Respect to Part of Lan~ Under the Williamson Act. NOTICE IS HEREBY GIVEN that the Council of the City of Bakersfield has fixed Monday, the !%th day of July, 1977, at the hour of 8 P. M. at the Council Chambers in City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public hearing on the matter of the petition filed by Frank Delfino, James Delfino and Tony Delfino, for cancellation of a Land Use Contract with respect to a portion of the land under such contract, which contract was entered into between the petitioners and the County of Kern on February 28, 1968, and recorded in Official Records in Book 4165 at Page 688, Kern County Recorder's Office. The land for which cancellation is sought consists of two acres located in Agricultural Preserve No. 11, located in the City of Bakersfield since annexation thereof in 1969, as follows: That portion of the northwest 1/4 of the south- west 1/4 of Section 14, T.30 S., R.27 E., M.D.B.& M. in the City of Bakersfield, County of Kern, State of California, described as follows: Beginning at point in the north line of the south- west 1/4 of said Section 14 from which point the northwest corner of said southwest 1/4 bears N. 89 degrees 02 minutes 07 seconds west, 622.41 feet thereon; thence continuing along said north line S. 89 degrees 02 minutes 07 seconds east, 3.13 feet to a point in the southerly line of White Lane; thence south 82 degrees 49 minutes 12 seconds east, along said south line 179.29 feet to the beginning of a tangent curve, concave northeasterly, having a radius of 6055 feet; thence southeasterly along said curve through a central angle of 01 degrees 54 minutes 42 seconds an arc distance of 117.58 feet; thence departing said curve south 00 degrees 57 minutes 35 seconds west, 412.00 feet; thence north 89 degrees 02 minutes 07 seconds west, 116.38 feet to a point in the centerline of an existing canal; thence north 21 degrees 22 minutes 07 seconds west along said centerline, 478.93 feet to the point Of beginning. Contains 2.00 acres. Said petition is on file with the City Clerk of the City of Bakersfield at City Hall, 1501 Truxtun Avenue, Bakersfield, California, and may be examined by any interested person during regular office hours. Said hearing will be held and conducted pursuant to the provisions of Government Code Sections 51280 - 51285. The owner of any property located in the City in which Agricultural Preserve No. 11 is situated may protest such cancella- tion. Dated this 27th day of June, 1977.
