ARESOLUTION OF THE COUNCIL OF THE CITY
OF BAKERSFIELD AUTHORIZING ASSIGNMENT OF
LEASE OF BEACH PARK PROPERTY.
WHEREAS, Agreement No. 76-110, entitled Ground Lease,
between the City of Bakersfield and Messrs. Burke, Kuttler and
Beguelin provides that any assignment of said lease must have the
consent of the City of Bakersfield by resolution; and
WHEREAS, Agreement No. 76-110 provides that consent shall
not be arbitrarily withheld; and
WHEREAS, the Tenant has filed a written request for such
consent; and
WHEREAS, the requested assignment is for the purpose of
assigning Agreement No. 76-110 and amendments thereto, with all rights
and obligations therein from Messrs. Burke, Kuttler and Beguelin as
individuals, to Bakersfield Courthouse Racquetball/Handball Courts,
a limited partnership, consisting of Messrs. Burke, Kuttler and
Beguelin.
NOW, THEREFORE, BE IT RESOLVED that the City of Bakersfield
hereby consents to the Assignme~ of Lease from Messrs. Burke, Kuttler
and Beguelin to the Bakersfield Courthouse Racquetball/Handball Courts.

I HEREBY CERTIFY that the foregoing resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 4th day of April, 1977, by the following
vote:
