A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD ADOPTING A SYSTEMATIC PROGRAM
FOR AMENDMENT OF MANDATORY ELEMENTS OF THE
GENERAL PLAN.
WHEREAS, Section 65361 of the Government Code prohibits
amendment of any mandatory element of the general plan more fre-
quently than three times during any calendar year, which amendment
or amendments may occur at any time as determined by the City Council;
and
WHEREAS, it is necessary to adopt a systematic program for
amendments to the general plan in order to'avert the possibility
that the maximum number of amendments will be reached early in the
calendar year and thereby foreclose justifiable amendments for a
lengthy period; and
WHEREAS, the possibility of reaching the maximum number of
amendments early in the year is greatest for the land use element of
the general plan; and
WHEREAS, the~Planning Commission at a regular meeting thereof
considered the restriction of no more than three amendments in any
one c~lendar year and recommended that processing of applications for
amendments be spaced in the manner set forth in this resolution as
a precaution against exhausting the number of permissible amendments
early in the year; and
WHEREAS, more than one amendment to an element of the General
Plan proposed by different applicants can legally be considered one
amendment to such element if so processed.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City
of Bakersfield that the following program of amendments to the manda-
tory elements of the General Plan is hereby adopted:
1. That all applications for amendment or proposed amend-
ment to any mandatory element of the general plan received from
January 1 to March 31, be processed as one amendment to such element,
in accordance with law.
2. That all applications for amendment or proposed amend-
ment to any mandatory element of the general plan received from
April 1 to July 31, be processed as one amendment to such element,
in accordance with law.
3. That all applications for amendment or proposed amend-
ment to any mandatory element of the general plan received from
August 1 to November 30, be processed as one amendment to such
element, in accordance with law.
4. That the Planning Commission is authorized to grant
variances from the above program for any particular'element of the
General Plan for good and sufficient reason, if the intent and pur-
pose of this resolution are served.

I HEREBY CERTIFY that the foregoing resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 21st day of March , 1977, by the
