HomeMy WebLinkAboutRES NO 6-77RESOLUTION NO. 6-77 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF BAKERSFIELD RECOMMENDING SYSTEMATIC PROGRAM FOR AMENDMENT OF MAN- DATORY ELEMENTS OF THE GENERAL PLAN. WHEREAS, Section 65361 of the Government Code prohibits amendment of any mandatory element of the general plan more fre- quently than three times during any calendar year, which amendment or amendments may occur at any time as determined by the City Council; and WHEREAS, it is necessary 'to adopt a systematic program for amendments to the general plan in order to avert the possibility that the maximum number of amendments will be reached early in the calendar year and thereby foreclose justifiable amendments for a lengthy period; and WHEREAS, the possibility of reaching the maximum number of amendments early in the year is greatest for the land use element of the general plan. NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE CITY OF BAKERSFIELD that it,be recommended that the City Council adopt the following program for amendments to the mandatory elements of the general plan. 1. That all applications for amendment or proposed amend- ment to any mandatory element of the general plan received from January 1 to March 31, be processed as one amendment to such element, in accordance with law.. 2. That all applications for amendment or proposed amend- ment to any mandatory element of the general plan received from April 1 to JUI~'~31, be processed as one amendment to such element, in accordance with law.~ _ 3. That all applications for amendment or proposed amend- ment to any mandatory element of the general plan received from August 1 to November 30, be processed as one amendment to such.-. element, in accordance with law, 4. That the Planning Cofmnission is authorized to grant variances from the above program for any particular element of the General Plan for good and sufficient reason, if the intent and pur- pose of this resolution are served.
