A RESOLUTION OF APPLICATION BY THE COUNCIL
OF THE CITY OF BAKERSFIELD PROPOSING THE
DETACHMENT OF ANNEXED TERRITORY FROM THE
PANORAMA COUNTY SANITATION DISTRICT.
WHEREAS, the Kern County Boundary Commission on May 16,
1961, transmitted to the City Council of the City of Bakersfield its
report and approval of boundaries concerning the proposed annexation
to such City of the territory designated as "Beale No. 1" as more
particularly set forth in City of Bakersfield Ordinance No. 1368,
New Series, adopted on June 26,196 1; and
WHEREAS, by Ordinance No. 1368, which became effective
July 26, 1961, said annexation was effected in the manner prescribed
by law; and
WHEREAS, by its Resolution No. 73-38 adopted on August 28,
1973, the Kern County Local Agency Formation Commission approved the
proposal for annexation to the City of Bakersfield designated as

"Beale No. 3, as more particularly set forth in City of Bakersfield
Ordinance No. 2152, New Series, adopted on December 3, 1973; and
WHEREAS, by Ordinance No. 2152, New Series, which became
effective on Janua_ry 3, 1974, annexation identified as "Beale No. 3"
was ef~fected in the manner prescribed by law; and
WHEREAS, by its Report and Recommendation of August 23,
1973, adopted by said Resolution No. 73-38 concerning "Beale No. 3,"
the Kern County Local Agency Formation Commission made the following
condition: "upon completion of the annexation proceedings the City of
Bakersfield shall forthwith institute proceedings for the detachment
of subject territory from the Panorama Sanitation District"; and
-- WHEREAS, this Council now proposes to effect detachment from
the Panorama County Sanitation District of the territories heretofore
annexed to the City of Bakersfield in annexations designated as "Beale
No. i" and "Beale No. 3," more particularly described hereinafter.
Thence (3) N 73°07'21'~, 96.72 feet, more or less
to intersect the westerly boundary of said Section
21;
Thence (4) N 0°29'16"E, along said last-named westerly
boundary, to Point of Beginning.
Parcel B - being the territory heretofore annexed to the City
of Bakersfield designated as Beale No. 3:
A parcel of land situate in the County of Kern, State
of California and being a portion of the southwest
quarter of Section 21, Township 29 South, Range 28
East, M.D.B.& M., and also being a portion of Drury's
Addition of Kern City as per map filed March 18,
1907, in Book 1 of Maps at Page 101, in the office
of the County Recorder of said Kern County;
Beginning at the intersection of the west line of said
Section 21 with the north right-of-way line of Jefferson
Street (formerly Main Street, of 80' in width, as shown
on said Drury's Addition);
Thence (1) de arting from the last-named west section
line S 73°07~21"E, 24.68 1 along
, feet, more or ess,
the last-named north right-of-way line to the south-
east corner of Lot 21 of Block 34, said Drury's
Addition;
Thence (2) N 16°51'26"E, 150 feet, to the northeast
corner of Lot 21, of Block 34, said Drury's Addition,
said northeast corner being also the south line of a
20 foot alley in Block 34;
Thence (3) S 73°07'21"E, 666.08 feet, more or less,
along the last-named south alley line and the south
alley line in Block 35 and extensions thereof, of
said Drury's Addition, to intersect the southerly
right-of-way line of State Highway Route 178
(VI-Ker-178), said intersection also being a
point on the north line of Lot 25, Block 35,
said Drury's Addition, distant thereon 1.92 feet
from the northeast corner of said Lot 25;
Thence (4) southwesterly along the last-named south-
erly right-of-way line the following 2 courses:
S 37°21 59" W, 110.28 feet;
Thence (5) S 46°53'25'~, 146.32 feet, to intersect
the south right-of-way line of Jefferson Street,
(formerly Main Street, of 80 feet in width, as
shown on said Drury's Addition);
Thence (6) N 73~07'21"W along said south line and
extension thereof, a distance of 248.36' more or
less to intersect the west line of said Section 21.
Thence (7) N 0°29'16"E along last-named west line
to the Point of Beginning.
Containing 2.60 acres more or less.
(e) The proposed terms and conditions to which the
proposed change of organization is desired to be subject is: none.
(f) The reason for the proposal is: The territory
contained within the Beale No. 1 and Beale No. 3 annexations to the
City of Bakersfield receives from said City as a municipal function
thereof all of the services and functions formerly provided to said
territory by the Panorama County Sanitation District; the detachment
of said territory from the said district will therefore relieve said
territory from taxation by both District and the City and will subject
such territory to taxation only by the City of Bakersfield, the entity
providing municipal services to the territory.
In accord with all the foregoing, request is hereby
made:
(a) That proceedings be taken for change of organiza-
tion proposed herein, to wit: detachment of Beale No. 1 and Beale
No. 3, the territory of which is particularly described above, from
the Panorama County Sanitation District.
3. The City of Bakersfield shall forthwith file with the
Kern County Local Agency Formation Commission 11 certified copies
'of this resolution, Form KCLAFC #7-NS (Proposal by Legislative Body)
and Form KCLAFC #27 (Environmental Assessment) pursuant to the regu-
lations of the Commission.

I HEREBY CERTIFY that the foregoing resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the ?th day of March , 1977, by the
following vote:
