HomeMy WebLinkAboutRES NO 11-77RESOLUTION NO. 11-77 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD ORDERING THE VACATION OF A SEWER EASEMENT NORTH OF UNIVERSITY AVENUE AND EA'ST OF MT. VERNON AVENUE, IN THE CITY OF BAKERSFIELD. WHEREAS, on the 3d day of January, 1977, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Service Easements Vacation Law," being Sections 50430 to 50445, inclusive, of the Government Code of the State of California, passed and adopted its Resolution of Intention No. 917 declaring its inten- tion to order the vacation of a sewer easement ~Or~h'of University Avenue and eas~,. of Mt. Vernon Avenue, situate in the City of Bakers- field, County of Kern, State of California; and WHEREAS, said Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on the 31st day of January, 1977, after Notices were duly published and posted as required by law. NOW, THEREFORE, IT IS HEREBY FOUND, DETERMINED AND RESOLVED by the City Council of the City of Bakersfield, State of California, as follows: 1. That said sewer easement, hereinafter described, is unnecessary for present or prospective public use. Said easement, situate in the City of Bakersfield, County of Kern, State of California, is described as follows: That certain strip of land, ten (10) feet in width, situate in the City of Bakersfield, County of Kern, State of California, being a portion of the North- west (NW) Quarter of Section 15, Township 29 South, Range 28 East, M.D.B.& M., the center line being described as follows: Commencing at the southwest corner of the northwest (NW) quarter of said Section 15; Thence (1) N 89°31'53"E, 170.00 feet along the south line of the northwest (NW) quarter of said Section 15, also being the center line of University Avenue; Thence (2) N 0°14'46'~, 93.00 feet along a line parallel to and 170.00 feet easterly of the center line of Mount Vernon Avenue, said parallel line also being the center line of that Sanitary Sewer Easement, Cencal Development Co. to City. of Bakers- field, recorded March 14, 1956, in Book ?_2.-576 , Page 565, Official Records of said Kern County, to the True Point of Beginning; Thence (3) N 0°14'46'~, 91.00 feet along last-said course to the Point of Terminus of this description. 2. That said sewer easement be and the same is hereby vacated and abandoned, subject to and in conformity with said Resolution of Intention No. 917. Reference to said Resolution of Intention is hereby made for further particulars. 3.
