A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD CERTIFYING THE FINAL ENVIRONMENTAL
IMPACT REPORT FOR THE RIO BRAVO ANNEXATION AS
COMPLETED IN COMPLIANCE WITH CEQA, THE STATE
EIR GUIDELINES AND CITY RESOLUTION NO. 10-75,
STATING THE COUNCIL HAS REVIEWED AND CONSIDERED
THE INFORMATION CONTAINED THEREIN, MAKING CERTAIN
FINDINGS AND CONSENTING TO THE ANNEXATION.
WHEREAS, the City Council of the City of Bakersfield has
authorized the preparation of a plan for the area proposed for annexa-
tion, known hereinafter as the proposed Rio Bravo Annexation, and the
employmentof Quad Consultants to assist the City staff in prepara-
tion of such a plan and to prepare an Environmental Impact Report,
both the above activities to serve as a part of an in-depth study
of the feasibility and desirability of the proposed Rio Bravo Annexa-
tion; and
WHEREAS, the plan for the proposed Rio Bravo Annexation,
including an analysis of the financial impacts to the City and recom-
mendations regarding development policies which would minimize such
impacts, was submitted by the City staffto the City Council in July,
1976; and
WHEREAS, the City Council directed modification of the
development policies recommended in said plan to insure that no cost
to the taxpayers now residing in the City of Bakersfield would accrue
as a result of development of the proposed Rio Bravo Annexation; and
WHEREAS, a draft Environmental Impact Report for Rio Bravo
Annexation has been prepared under the direction of the Development
Services Department of the City of Bakersfield and circulated by and
through the Kern County Council of Governments, the area-wide clear-
inghouse for the City, in accordance with the requirements of law
and applicable regulations; and
WHEREAS, on October 6, 1976, a public hearing was held on
the draft Environmental Impact Report before the Planning Con~f, ission
of the City of Bakersfield and verbal testimony taken supplementing
the written testimony submitted to the City prior to said hearing; and
WHEREAS, several public agencies requested an extension of
time to submit comments to the Planning Commission regarding the
draft Environmental Impact Report; and
WHEREAS, the Planning Co~nission granted a time extension
for the submission of additional comments concerning the draft
Environmental Impact Report; and
WHEREAS, the City has responded to all significant environ-
mental points raised by the public agencies and private persons com-
menting and any such points raised in the consultation, review and
public hearing process.
WHEREAS, at a regular meeting of the Planning Co~L~f~ission,
on January 19, 1977, the said Commission reviewed the Final Environ-
mental Impact Report, made certain findings, and reco~L~f~ended that
said Final EIR be certified by the City Council as being in compli-
ance with the California Environmental Quality Act, the State EIR
Guidelines and Resolution No. 10-75 of the City of Bakersfield.
NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY
OF BAKERSFIELD:
1. That the final Environmental Impact RepOrt dated
November, 1976, is an accurate and objective discussion of the pro-
posed project and adequately discusses and describes all of the
environmental considerations which need to be considered prior to
the evaluation or approval of the proposed project.
2. That the changes, alterations and mitigating measures
which have been required in, or incorporated into the project would
mitigate or avoid any significant environmental effects thereof as
identified in the final Environmental Impact Report with respect to
impacts on visual effects, topography, geology, meteorology and clima-
tology, air quality, soils, vegetation, wildlife, archaeology and
historical sites, ambient noise levels, land use, local government,
public services and utilities, surface and groundwater hydrology,
transportation facilities and water quality.
3. That such changes or alterations and mitigating effects,
with respect to surveys, groundwater hydrology and water quality,
include a recofmfxendation in the final Environmental Impact Report
that LAFCO may wish to suggest as a condition of its approval of
annexation, that the City have contracts in effect with consultants
for further detailed studies and plans, for area wastewater manage-
ment and water resource utilization for the Project area, within
thirty days after the effective date of annexation and completed
within a reasonable time thereafter; that the paragraph relevant
to this matter on page 104 of the Final EIR be amended consistently
with this paragraph.
4. That, although the project inherently provides for and
permits growth in the project area, urban growth would probably occur
in the area without annexation to the City; further, the project will
not cause incremental growth in the Bakersfield urban area but rather
provides an alternative residential location for growth basically
induced by other causes.
5. That the developmen~ control policies of the City
Council, as incorporated in the plan for development of the proposed
Rio Bravo Annexation, will insure that there will be no incremental
costs to the citizens and taxpayers of the existing City of Bakers-
field as a result of the project.
6. That the proposed project will not have a significant
effect on the environment of the Southern San Joaquin Valley.
7. That the proposed project is environmentally more
desirable than the alternatives which were considered.
8. That the proposed project will provide long-term bene-
fits_for the-City by giving the City a residential growth alternative
in order to meet its needs for long-termurban growth.
9. That the proposed project contains social, economic,
and environmental benefits which outweigh any environmental risk
associated therewith as enumerat~ed herein.
10. That this Council hereby certifies that the Final
Environmental Impact Report for the Rio Bravo Annexation has been
completed in compliance with the California Environmental Quality
Act, the State EIR Guidelines and City Resolution No. 10-75; that
the Council has evaluated, reviewed and considered the information
contained in said Final Environmental Impact Report.
11. The City Council hereby consents to the commencement
of proceedings for the Rio Bravo Annexation, pursuant to Article 5,
Division 2, Title 4 (commencing with Section 35300) of the Govern-
ment Code, and requests the City Attorney to submit to the Local
Agency Formation Commission of Kern County an application to initiate
proceedings for such annexation.

I HEREBY CERTIFY that the foregoing resolution was passed
and adopted by the Council of the City of Bakersfield at a regular
meeting thereof held on the 24th day of January, 1977, by the follow-
ing vote:
